I notice a lot on these type of boards about how Triton behave, but I need a little help from you guys please!

 

I have £6000 outstanding with these guys, £5000 for a loan and £1000 for a current account that I moved away from!

 

Basically I was made redundant, Natwest weren't very helpful so I moved to a different bank when I got a new job as I had a feeling they would just take whatever funds they wanted from my account!!

 

Anyway they passed the 2 accounts to Triton, I agreed (over the phone daftly enough) to pay £100 a month which would pay the debt off over 5 years'ish. They confirmed verbally that this was the case.

 

I have since been told this is not the case and they are refusing to freeze interest so of the £400 I have paid off the 2 accounts less than £100 has come off the balance!!

 

The brunt of the question is if I stop paying these guys, will they pass the debt onto a debt collection agency or will they take legal action?

 

I am not too concerned if they pass it on, I would prefer it in fact but I do not want legal action.

triton are NW's inhouse monkeys anyhow.

if you stop paying then yes, most prob legal action would eventually result.

 

however.

have you not got PPI or something you can reclaim on the loan?

i cant see how they agreed to freeze interet on a loan that was already running

 

what do you mean here? are they charging you MORE than what the loan was for?

No I dont have PPI, I am working again now anyway but earning a lot less than I was.

 

I was happy to pay the £100 / month as agreed which meant it was paid off over 5 years, however they are now saying there was no note on the system about freezing the interest which means I continue to accrue interest on the loan and will still be paying the £100 / month WAAAAYYY after the 5 years!!!

 

Does that make it a bit clearer? I was hoping they may sell the debt on.

the loan agreement will show that you have to pay £XXX PCM.

 

thats it.

 

if 'more' or additional interest is being added then that is unlawful.

I am paying a reduced amount as I cannot afford the original agreed repayment.

 

However as the loan is one of the type that the interest accrues over the loan period and as I am paying less the length of time to pay it off will be ridiculous.

 

I was just hoping they would sell the debt on rather than take legal action.

post up the agreement.

 

dca's have no legal right to vary the terms and conditions of a signed agreement.

 

something smells here, if they are trying to suggest that by doing this or that it will save you money and stop the world murdering your aunties budgie, i would doubt the paper the agreement is written on.

I've drafted a letter asking for a CCA, which I'm going to post tomorrow....

 

Can anyone confirm if in this situation they sell the debt on or take legal action though?
