      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I have gone through the figures with Zebra Money Management, Gregory Pennington and CCCS. I am 17K in debt and am now on reduced hours. I am looking at a repayment of around £230 a month which all can do but CCCS is nealry 2 years less. I am unsure of what to do - who is the best company to trust with a DMP?

I've been with CCCS nearly 2 years now and everything has gone smooth except with one creditor who took me to court, CCCS just said to me well your not going to defend it are you as you admit you owe it and told me where to fill it in and sign, never mentioned I could do it on the internet, they DO NOT want you to fight it. However I did fight it with no help from them but with the help from the caggers and with their help managed to get it struck out. One creditor has still not stopped piling the interest on and I asked them to write to them but they never informed me if they did or what the response was. I wrote to the creditor several times and they didn't even acknowledge my letter. I will eventually go after the creditor for my CCA and then over the charges when I get the time. So remember they cannot guarantee you anything but at least it is a free service and it DOES stop the creditors hounding you.

Hi

I have been unfairly dismissed after 6 months of suspension.

 

My dmp is with step change and

 

they have not been paid for 2 months as I have been on half pay for sick!

 

I'd thought I'd be back at work with an apology but alas no, sacked.

 

So what can I do now.

 

My debts are about 14k,

mostly pay day lenders but they are about 2.5 k worth,

 

2x very old welcome accounts that have just gone to Aktiv Kapital,

vanquis card,

blackhorse for dfs settee,

an old orange account, and

Cabot who have taken on my very old overdraft from Lloyds. ( 10 years old)

 

I know the debts are my fault.

 

I have been paying step change for nearly 6 years but now can't.

 

My partner has no idea and I can't mention it as these came about after I was very depressed.

 

Now I've lost my job but have an excellent chance at a tribunal.

 

Shall I dro it?

 

Was bankrupt back in 2001 due to my ex boyfriend and lost my house and everything.

Can't risk being in the paper again.

 

Please help, don't say tell your partner as she will kick me out.

 

I know how unsafe I would be in that position with my illness.

have you ever questioned these debts by CCA requests?

 

the welcome debts will have LOTS of PENALTY fees reclaiming and PPI to get back I bet.

 

if any of the debt are NOT on your CRA file

then i'd consider operating a DMP yourself.

and paying them a lot less

after they pass the CCA test.

Hi

Lots of fees from welcome, they've now gone to aktiv kapital. I ccad them a few years ago and they just sent me a copy of my original documents. Think maybe scanned and on here somewhere.

Some payday loans gone from 200 to over a 1000

Shall I cca all of them?

Is that the one youd send 1 pound postal order. How do I see how much I have paid them over the years?

I have the original agreements but not anything about charges. I didn't take ppi cos I cancelled the minute I left the showroom. Have been charged loads though.

Have a word with National Debtline and enquire if you qualify for a Debt relief order ?

 

Unless you own your own home.. then I dont think you will .

Welcome car is over 10 years old.

 

Vanquis 6 years.

 

Lloyd 10 years.

 

Been paying forever.

 

Can't afford to sar all individual debts as there are about 19 of them.

IMHO you are being cash cowed on atleast 50% of those debts.

 

close the stepchange DMP

 

and we'll deal with them.

Sorry for being thick but what's cash cowed

Some of these payday lenders below the amounts are original amount borrowed plus one month interest plus charges.

Some of them are OK

but others write to me saying nearly 1000 owed on original amount of 200 borrowed.

Also not sure about aktiv kapital taking over welcome.

Youve got nowhere because you are being cashcowed big time, and theyre still adding on interest, and selling the debt on to their friends, so they can milk you dry too.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

£1 per postal order per account. Send it to the company chasing you.
