Quick question for a colleage of mine....

 

Her daughter who received a new Samsung tocco lite as a Christmas present a mere 3 months ago receives a text from 3 mobile on a Friday a couple of weeks ago that her phone will soon no longer be supported on the 3 network as it is only a 2g phone. The following Friday her phone was cut off, much to the anger of her mother as her daughter was away with friends at the time.

 

Her mother rings 3 up and was informed that yes madam we no longer support 2g phones and you will have to buy another phone from the 3 shop.

 

The phone was originally bought from an independant and unlocked. The sim was from a previous phone that was on a 3 contract.

 

Is this not a breach of contract as there is still 18 months to go?

 

And...Has anyone got a contact email for the UK Managing Director as talking to Mumbai or where ever led to even more frustration as they were clearly reading off a script

Its not a breach of contract by 3.

 

3's contract section 6.6 states:

 

You must only use Handsets and Accessories authorised by us for Connection to the 3 network and also comply with all relevant legislation relating to their use.

 

3 - Help & Support - Terms and Conditions

 

Your friend has no reasonable grounds for complaint, your friend is in breach of contract not 3.

The reason it was called '3' (and not '2') was it was a 3G network, and they had no 2G network of thei own. To facilitate the roll out of their network, they arranged for a competing 2G network to take up the slack and fill in any gaps in their service. However, this backfired on them, as folk did what you did, and simply used old phones to access the service, and all those calls cost 3UK lots, as they were not handled by them.

 

That said - the Tocco IS a 3G handset - so there is every chance the settings have this switched off in error. Turn in on, anf 3UK will be happy again.
