    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have used Adaware for years, along with Spybot S&D.

Between them, they used to take of scumware, quite nicely.

I recently upgraded to Adaware Anniversary Edition, which I have had nothing but trouble with.

I download and install it. Sometimes it will run, but other times it will not. If it DOES run, then it will only run once. The next time I try to use it, it throws up a box saying "Cannot Connect to Service" or something similar.

I recently found that they have now brought out a later version, but that does the same.

I might add that this is happening on two different machines.

Has anybody else had this problem? Any suggestions?

If not, then I am going to have to find an alternative program.

Must be good..... Must be free download/freeware.

hi rooster.

having been in the game since before PC's were made......urm getting old.

ive dealt with 1000's of these over the last years. good n bad.

my pers fave at present is

microsoft security essentials.

its from MS themselves, and i admit in the past, these MS packages have been less than useless.

however MSE is brilliant, and by far the best i have ever used.

i've just about junked all my other tools to deal with threats now, and whatever i have to deal with, bung on MSE and it sorts it.

and its free!

Thanks, DX, that's one to have a look at. Does it require the windows OS to be registered?

Alternatives if you cannot download MSE are. Avast (free) and Malware Bytes (also free). The former has a real time scanner and has helped me get rid of nasties from many a peeps computers. Malware Bytes is a program you can run a scan on every so often and is also brilliant.

Avast also updates itself every day or two without you having to do anything. It will run in the background all the time, and if someone lets a nasty get past it, then you can do a scan.

I'll get you the download links if you want Rooster, but you just have to Google them.

PS. Avast will do a complete scan of your system as soon as you install it, so make sure you have a bit of time. It only needs to do this once as it scans all your start up system files. Well worth the wait though.

It's been a while since I've had a tickle of the scales from a Mod. Hint Hint!!

Are you after some anti virus software or just some alternative on-demand malware scanners. If the latter, then Malware Byte's Anti Malware (already mentioned above) and Super AntiSpyware are the two that seem to get most recommendations. They are free and you can download and use both them both together if you wish.

Be careful not to install a new AV (MSE or Avast) if you already have AV software installed, as this can result in conflicts and neither working correctly.

Hi Migster. Thanks for the suggestions.

Just scumware remover. I am already running Symantec Corporate v10.

hi rooster.. personally, I would remove the norton you have on there at the moment. If its a trial version all the better, and then download / install another combination. As mentioned, Avast, Avira, and my personal favourite at the moment Comodo are heaps better than norton.

IMO it slows your pc down dramatically, does what ever it wants to do, when ever it wants to do it. Also isnt the worlds greatest at finding what it should..

If you have purchased it, then again personally, I would leave it for the moment, till the licence runs out, then remove, and install another one..

hope this helps

be safe

jgg :)

A huge ditto from me.

Install CCleaner, run it, click on tools, click on Norton, Run uninstaller. I cannot believe these people charge for something FAAAARRR less superior than the freeware on offer.

Symantec Corporate does everything that I want it to. It auto protects PC and checks every file downloaded/loaded into the PC with no noticeable reduction of speed. Checks emails. Auto update, (mine is set to check for updates every night). Permanent licence with no limit or charge for updates. It can be used on managed or unmanaged systems, on individual machines or on a server, controlling a network of PCs. Works well.

Just downloaded and installed Malware Bytes. It took 2.5 hours to check my PC because of the sheer number of files onboard. Most of the time it was checking temporary internet files, so I'll clear them, the next time I use it. It found only one scumware file.

I have also downloaded, but not yet installed, Super AntiSpyware. I'll try that tomorrow night.

Thanks to everyone who replied, much appreciated.

re the temp files, if you run ccleaner, that will remove them all for you. when you run malwarebytes, please, please please, update it before running. as far as im aware, these guys update their definitions files, at least twice a day.. sometimes more.. they are awesome..

your lucky on the norton then rooster.. as soon as a pc / lappy comes in the workshop here, it gets removed, for the reasons stated, and nearly all of my customers experience the symptoms i mentioned, and hate it nearly as much as i do..

be safe jgg :)
