Its 4am and i cant sleep for worrying about money.

 

I am a teacher with extremely difficult pupils so need to be alert but cannot sleep at all.

 

Have 2 payday loans causing me problems.

! with quickquid and

one with wonga.

 

Both defaulted a couple of months ago.

Letters sent to both saying cant afford to pay and offering installments but both ignored.

 

Quikquid have brought in McKenzie Hall who have been ringing me constantly.

I havent answered and have changed my mobile number to try to stop them

but then they just rang my boss and were extremely rude to him.

He was obviously not too pleased and told me in no uncertain terms that he couldnt have them ringing work for me.

 

Going to send out letter to them to ask them to correspond in writing only.

Quick quid initially not to bad with harrassment but now had letter to say passed on to debt agency.

Both companies have totally ignored my letters.

 

I need to get them to agree installment plans but over a number of months.

I want to start paying them something but dont have their bank details to set up standing orders.

Any other suggestions about paying them.

 

My thought being that if i can prove i want to pay a court will not let them instruct bailiffs which is my main concern.

 

I am so tired and so stressed its untrue.

Hi Ken,

sorry to hear you're having problems.

You're not alone though, and you'll get all the help you need here.

 

You're acknowledging the money you owe and want to find a solution.

Thats a good start.

 

You say you've offered to pay in installments and your letters have been ignored.

 

Write to them again and repeat your offer.

Whatever your offer is, send a postal order and make it out to whoever the money is owed to.

Send it by recorded delivery and keep a copy of everything.

You can check if it had been signed for by loggin on to www.royalmail.com and use the track and trace facility there.

 

Type in the reference number and it should tell you who signed for it, and when.

To check if a postal order has been cashed, phone 01246542091.

Keep your receipts, as you will need to quote the reference number there too.

 

Most DCA's use lots of methods, fair and unfair,(usually unfair) to get you to pay.

Try not to worry over this

.Easier said than done I know.

 

A lot of us have been through similar situations.

I think it unlikely that this will go to court.

Even if it does,

at least you will be able to show that you are making efforts to pay this off,

and the court may well order you to pay a lesser amount per month than you offered in the first place.

 

As I said, keep a copy of everything, and whatever you send,

use recorded delivery and keep all receipts.

KKen, you're a million miles off Bailiffs! Don't worry about that, these guys are highly unlikely to ever even take you to court. They'd have a great deal of difficulty explaining their interest rates to a judge. :D

 

Firstly, have you read the rest of the payday loan threads on here? There are some really good tips on how to deal with these people.

 

You're right about getting the harrassment letter off as soon as possible, and I'm really sorry that they've already been rude to your boss.

 

Have a skim through a few of the other threads, then if you need more help, we'll take it from there.

Feeling pretty awful right now due to lack of sleep and need to get this dealt with as i have to be on the ball with this job.

I have always found it best to use email addresses of individuals within the companies to organise payment plans with - call someone in the copany, get their email address and email a copy of the payment plan. Also insist on written comnmunication only.(otherwise you can threaten to contact their employees and complain i.e. their brokers)

 

I have done this with payday loan companies and most have account managers assigned to collecting the money from you and as long as you communicate with them, things can be worked out.

I feel totally defeated by this whole merrygoround now.

 

I have got in a mess with 2 payday loans,

1 to quickquid (£400) and

1 to Wonga (£400).

 

Quickquids has been passed to Mackenzie Halls and Wongas to Barker and Lowe.

 

I have sent letters and emails to both Wonga and Quickquid offering instalments

(albeit £40 each per month) as that is all i can afford but had no response at all except for DCA's contact.

 

Have now sent letters to DCA's offering the same but no response as yet.

 

Wonga now say i owe £1400!!!, Quickquid now say £560.

 

In addition, i have a DMP with CCCS, sincerely didnt think a payday loan would be a problem under a DMP

as it isnt a long term finance arrangement but have been told by someone on here if CCCS

find out they will chuck me off DMP.

 

Dont know what to do next, feel ill with stress and understand completely

how people cant go on under mountains of debt, dont know what i would do if i didnt have my kids.

 

In addition, just received a charging order application in post this morning

for a debt that is being paid under my DMP. Desperate now!!

hi kken67,

 

I think you may need to consider moving your DMP to a different company and including these two payday loans,

 

I had a loan with Quikquid and this is included in my programme with Gregory Pennington,

 

the problem is that you can't include these into your current plan with CCCS as it is fraud to take out further credit if your in DM.

 

If these two payday companies were to take you to court they may rule in their favour.

 

Also if your other creditors on your DMP were to find out they could also take you to court.

Hi,

I was on a dmp with the cccs and when i told them i had got into a mess with payday loans they said they were no longer able to keep me on the plan as one of the conditions of a dmp is that you dont take out any more credit.

 

My advice would be to keep quiet and try and come to a payment arrangement with the debt collection agencies.

 

I have got an outstanding payday loan with quick quicd which has just been passed to Mckenzie Hall.

 

So far they have been fine and i am going to start paying 30.00 a month by s/o, starting from next month(balance is 525.00)

they do not respond at all and months have now passed.

I am so sure that they avoid replying so they can add on more charges.

 

The quickquid one is being dealt with by Mackenzie Hall and i have sent yet another letter today demanding they respond to my offers and also saying i believe a judge would take a dim view of them not trying to reach a mutually acceptable agreement.

 

They just send more letters threatening court action.

Wonga are using Barker and Lowe which i know is just another desk at Wonga.

 

My last recorded delivery letter was returned addressee unknown!

I sent a similar letter to Wonga as sent to Mackenzies but did put that i hoped they werent ignoring my letters in order to bump up the charges.

 

Has anyone got any idea how i can pay them when they are not giving me their account details.

I have told them that i will pay by standing order to safeguard my bank account but i could do with finding a way to pay them in case they dont send the account details i requested.

 

I know not to send a cheque as they could get details off it for my bank account.

 

If they take it to court,

do you think a judge would accept i am trying but they are being obstructive.

 

I have kept copies of the leters i have sent to them both.

 

Maybe it would be better if they did go for a CCJ,

what are your thoughts on this.

Before I even start to write a response, I should introduce myself; a 26 year old male from with a college degree in finance (and psychology), whom at the moment is 3 months away from completing my law degree studying international corporate law. I live in Chicago, Illinois, USA and I work as a legal consultant for Quick Quid... So hopefully I am qualified. And I'll also state that even though I get paid by QQ (pay is pretty terrible) I have no moral or ethical allegiance.

 

That being said, here is some advice:

--Why don't you try ringing them? It would be much more direct than email or letter mail. Also, QQ only adds charges if you extend your loan or if your bank doesn't honour payment.

--Per rule of law, you cannot demand anything from creditors. You signed a mutually binding contract which cannot be modified unless both parties willingly agree. QQ held up to their end of the contract by giving you pounds, and it's obvious you did not repay as agreed.

 

3. QQ cannot withdraw funds from your account without speaking to you. You can send a check ; they CANNOT (by law) debit ANY FUNDS without your permission.

 

Finally, if you want to pay, just pay. QQ will probably not proceed with court action as it is more expensive than the loan you took out. So you can just forget about it if you don't care about your credit. but if they do, you will (most likely) be at fault because you accepted and spent the funds from QQ and signed a loan contract, and you have breached it by not paying.

I have been writing to Wonga continuously for a few months now trying to get them to agree an installment plan but they dont even acknowledge my letters which i have sent recorded delivery.

 

I than got a letter from Barker and Lowe.

I sent them a letter and it was returned unknown at this address.

 

Today i have received a letter from Sherwins saying debt is now £1400 on original debt of £400.

 

Who are Sherwins, are they just Wonga under a different guise.

 

Cant get anyone to respond but i guess for them it just keeps things going longer so they can keep piling on the interest.

 

Any suggestions?
