    • Okay so potentially it may not even get sold on? Just the default left for 6 years then gone? but if it is sold on ill get a letter from the DCA which is the notice of assignment? Sorry what is the different between a default notice and a default cal marker? yes, i may try and work arrangements out with the OCs after the breathing space but I'll see my circumstances then thank you again for all your help and patience, I really appreciate it and apologies If i am too fast or repeating myself.
    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx  
    • okay thanks do you know how long it will take for it to get to the DCA or could the OC try and issue a CCJ? even though it's unlikely also for example would the OC agree to a reduction and a small payment over a super lengthy period of time if agreed? Rather than go through chasing apologies again for all the questions, just trying to understand all the possible scenarios.

    • depends what the fees are, typically nothing can be added once judgement is passed bar litigation costs. on document retention time limits etc at least 6yrs previous must be held though many hold complete info. as for acronyms and abbreviations ideally yes they should

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I already have a thread on my Barclaycard case going but thought i'd start a new one to try and gain some fresh input.

 

I have had my ppi claim refused by Barclays, but before i go to the FOS i decided to hit them one last time so i sent them another last chance letter to look at my claim.

The problem is this. I gave them 14 days to give me a final offer and they have responded by sending me a questionaire to fill in to help their enquiries!

 

Has anyone else had anything like this?

Part of me does not want to fill it in as its basically asking for info regarding the sale of ppi, to which i have already explained to them.

They also ask for details on other insurane policies which i may have had at the time. I feel that this is none of their business .

 

Just wondering how i should play this one?

 

Admin, if you are not happy with me starting this new thread please let me know and i will add it into the existing one. Just trying to gain a fresh response

Hi LDG,

 

Only my opinion but I woud fill out the form and send it back.

 

MBNA initially refused my cliam and requested further info which I complied with, (copy of Corporation accounts), and received a refund within a week.

 

It was a derisory amount but did give me the ammo I needed to go to the FOS for the interest & restitutionary damages as they have, by paying up, admitted that it was miss-sold.

I have just helped a buddy of mine to complete the same questionaire from Barclays, i attached a copy of the original letter that was originally sent ( Same as you ) so on the vast majority of questions i wrote 'As per attached letter' because the information they were asking for had already been put in the letter.

Debt Free Since 1st September 2009:D

 

Target Savings For 2010 = £1000:)

 

Savings So Far = £700:lol:

We recently filled one of these in, after our initial letter saying we didn't recall agreeing to PPI in the first place and wanted proof that it was sold correctly. most of the questionnaire was filled out with "No" because it was asking about things like self employment, housewife, etc, which wasn't the basis of our claim.

 

They wrote back shortly after offering the refund of PPI up to the point they'd taken over the account, so we wrote back thanking them for accepting that they had no sufficient evidence, and that we expected to be refunded the full amount from when PPI was first applied, 3 years earlier than when BC took over.

i have filled in the questionaire now and it will be sent in the morning. It has asked for a signature which i was reluctant to do . But i have crossed the signature so they cannot reproduce it on any other documents

Well i sent the questionaire back on the 4th March and as yet no reply. Think i'm going to give up on them and hand to FOS now as this has been going on since last year .

they do seem to take a while to process, to be fair. After my last post about them only offering a partial settlement since they took over an LFI account, and telling me this was their final position on the matter should I choose to follow it up with the FOS, I sent them a final chance to resolve it themselves, showing them the schedule of fees dating back to 2005 when the account was first opened. I gave them 4 weeks to handle the query, and lo, on the last day possible, just as I was drafting my FOS complaint, they responded with a full settlement including £500 interest payments on top of the £3700 PPI premiums that had been paid.

 

I think in all, this took about 3 and a half months to have it dealt with, from the initial request for info about the original PPI agreement, to the questionnaire, to an initial acceptance of no supporting evidence and partial refund, to the full refund we've received as of this week.

Good news! Barclaycard letter this morning.

They say "having reveiewed your complaint i feel there is a lack of supporting evidence to confirm the the sale of ppi was carried out in accordance with our standard procedures"

 

As a result all ppi premiums plus interest refunded!

Its only a small amount but its a win!!!!!!!

and the second one this week!
