  Why did you head your question "Magistrates Court Act 1980, Sect 12(3)(B)? When you say your brother has been "Summoned" to the Magistrates Court, what exactly has he received? Summonses are rarely used these days. Proceedings usually begin with either a "Postal Requisition" or a "Single Justice Procedure Notice".

  I wonder which part of your WS VCS didn't fancy going to Court to defend. Congratulations on the painstaking way you must have gone through many legal points on a good number of different threads. It has paid off. Might there be a way of getting some sort of payment out of them from a GDPR basis?

I was hoping someone could help me, I am being bombarded by debt collection agencies & solicitors on behalf of Lloyds, I have tried to get my charges back but only by sending the template letters from the forum I have not lodged anything with the courts yet. I had just received my 6 yrs statements when the OFT lost the fight in Nov. I have now read there is a new avenue to explore what do I actually quote or is it not ready yet & what do I do about all the pressure they are applying.
