Thanks for the replies. It was just a theoretical question. I'm withholding payment from AMEX as a result of an unenforceable cca. The DN dropped off my credit report last year, however I was concerned that they would default me again. I believe that if you withhold payment due to an unenforceable cca, your creditor can default you, as in MCGuffic vs RBS. DN’s are hard work to live with and I certainly don’t want another.
