Hi, I have a long and arduous ongoing battle with BOS and their Preference Account - I am soon in court for round two and the main argument they are puting forward is that the card is not a credit card and therefore does not come under the CCA 1974.

 

I am arguing that it is a credit card... amongst other things like no Default Notice etc...

 

If you are a Preference Account holder and have anything that can help me prove that they themselves sold it as or now treat it as, a credit card, and would be willing to submit a witness statement by mid March, I would be very interested to hear from you.

I'm a L-Plate cagger - new at all this but determined to learn as much as I can, to help as many others as I can, and to fight back as often as I can!:-x

Any help or advice from me is offered in good faith, based on my knowledge and experience gained either from here or from my own cases. I am NOT a legal expert. Just to clarify for anyone who hasn't read FDPM's thread, check your credit reference file. Does it say the account is a credit/store card? Check any correspondence from the Bank, DCAs or anyone else - how do they describe the account? Did you know it was a bank account when you got the card? Were you ever given the option of having your salary paid in to the account or using it to pay direct debits or standing orders for example?
