Hi lbl and huge welcome to the site!

 

Its great you have taken the time to help others here, the misery caused by this company is so sad and I am soooo happy that awareness is growing about them.

 

As you may have read, my experience of this company has been devistating on the lives of myself and my family. When they took my car after a long battle with them I lost everything, I couldn't work as I was self employed, my business went under, my house was repossessed and I then had a baby followed by a full mental breakdown, causing heartbreak for my children and family.

 

My loan with them was for £9k and they took my car worth £30k and my private numberplate. They say they sold car and numberplate for £14k and they said I owed them £16k for loan and interest so they say I still owe them 3k!!. Whoever bought my car has now taken my numberplate off the car and are selling it online for £27,500 even though they paid nothing for it. So in short I lost a car and numberplate worth nearly £60k for a £9k loan. I have never received proof the car was sold at auction and find it hard to believe it was, there would have been a stampede as my numberplate was very rare and clearly worth alot of money. I did ask for it back after they took my car, they said tough it was theirs. This is just spite in my opnion as I told them the plate meant alot to me (bought by my husband who I lost in an accident) and was an investment for my children, they couldn't care less.

 

I have found out alot of things since and I am preparing my court case with my solicitor. I can't go into much details about my case because I know they watch this forum but look forward to telling all about everything as soon as I WIN my case against them!!!

 

I found what you said about people signing the bill of sale without knowing very interesting. Its the most frightning part of how this all works. I know for a fact there was no explination of the agreement and it was not mentioned at all and I have a witness to this, don't recall signing it at all. Have you seen the bill of sale agreements they use? They are not official looking documents at all and made up very similar to their other agreements (i.e don't stand out or written in clear understanding terms). Its ditsturbing that this very unofficial looking agreement is then registered with Royal Courts of Justice which is very official. I don't think anyone in their right minds would sign such a document if its implications were explained and meant lbl owned the car.

 

The way I think this company works is they give loans to anybody regardless of income, credit rating or ability to pay and this bill of sale gives them the power to do whatever they like. They have no customer service to speak of, pounce on you if you miss just one payment and offer no help or affordable arrangements to pay any arrears or they offer further loans making matters worse pilling charges on all the time. They make it so difficult to pay that in most cases the car is then taken and never seen again. They say they sell cars at auction but no proof is given and they are always 'sold' for much less then they are worth. The main point is that as soon as you sign the bill of sale (that you are not aware of signing) they don't care how you conduct your account and will take car at first opertunity and sell it for their own profit leaving people with nothing but upset anger and frustration after losing a major asset that can never be replaced. My own experience was slightly different in that I was in a major dispute with my repayment amounts but they wouldn't listen and didn't care less, they took the car and laughed in my face.

 

They have found a very clever [problem] but i does have major flaws (again i can't go into this which is annoying but will damage my case) but with majority being in financial hardship prior to going to them for 'help' they know how hard it is to get the right legal advice and funding they need to fight back.

thanks nellie,can i just check with you in your contract did you have the no repo if paid over a 1/3?If so should that be in a lbl contracts?

Its not in my contract but I don't think its normally in contracts although I could be wrong? I know they don't want you to know that info though but I am not very clued up on it as i have never had normal car finance so not sure if it should be in the contracts - in other words I am useless and don't know anything:D !! lbl did say it wouldnt apply to logbook loans contracts though

Hi Nellie , I am in Fife I also thought the bailiffs were illegal here but they just do what they want . I hope you get this sorted out soon though and the best of luck . Alex

Hi Alex, yes I can relate to Balliffs on power trips! Thanks for support, Going through courts is a slow process but I can honestly say I can't wait to get them in front of that judge :-D

It goes without saying that i hope you have your day in court with these lowlife and get recompense and more for all they have put you thru, but i've got to ask, how the hell did they manage to sell your number plate. I know it would have been physically on the car but did you have to surrender the docs for it to them?

At the fear of sounding like "teaching you to suck eggs", have you checked with DVLA that its been transfered to someone else? Dont YOU the plates owner have to sign the transfer document? If you haven't signed any trnsfer docs, isnt this major league fraud that needs reporting to the police?

As a family with three vehicle with cherished numbers, I can assure you that if the vehicle changes owner before the number is transferred or placed on retention, then the ownership of the number transfers to the new owner of the vehicle - it is then too late to claim it back unless they are willing to sign transfer documents and present the vehicle for inspection if necessary.

 

You must have ownership of the vehicle or the owners signature on the necessary docs in order to place the number on retention. All the paperwork that you get from the DVLA tells you that you must not sell or transfer the vehicle until the transfer is complete (retention certificate or new V5)

Nellie did ask Logbook Loans to transfer the plate back to her, but they refused as it was "on the car when we took it so it's ours now..."

 

From what I know, the trade value of the car used to calculate the loan amount would not have taken the value of the number plate into account as there is no way to secure the number plate, only the actual vehicle.

Yeah I found out about numberplate situation quite early on and was a huge shock and took alot to get over. I pleaded with LBL to give it back to me, at first they said they might do then just refused. I explained what the plate meant to me personally and they just said it did not make any difference and basically told me to get lost. It would not have made any difference to them to assign the old number plate or give me time to put it on retention.

 

Now the thing that puzzles me is they say they sold car at auction (for half its value) and they had no financial interest in it and it went with the car at auction. If this is true they basically gave away the number plate free with the car, its very rare and stands out a mile, quick valuation would prove its worth at least £25k (plus I told them this). So why would the car go for such a low price at auction?? Anyone in their right minds would know the plate was worth alot so wouldn't the bids keep going?? Then it turns up for sale for £27,500 on the internet (very well known firm). So in short the car was taken by CAR balliffs, by CAR finance company, sold at a CAR auction and all these people dealing with cars everyday didn't notice it had a valueble number plate, Joe bloggs just came along and got a bargain car with a free number plate????? Any Ideas??!!!

Nellie, I don't know anything about your individual case, but would imagine that Logbook Loans were well aware of the value of your number plate. I would be very surprised if it went with the car, and wasn't sold separately. Of course, being surprised doesn't prove anything, but I'm sure there must be ways of finding out. Have you tried a HPI check on the numberplate? that would show when it was transferred off the car, and should indicate whether it was done before or after the sale. You can get a cheaper check than HPI that should give the same information here

Yeah I did an HPI check and it showed car being assigned its original number plate, was not suprised to see it was after they said it was sold at auction, but I only have their word that it was sold at auction, never had any proof it was, I have asked them for proof many times.

Dear All

I slightly different tail.

Any help and advice will be gratefully received.

I bought a 2003 Nissan X-Trail low mileage, however it was declared off road.

Front window broken, bald tyres, no MoT, dead battery, you get the picture.

I got the V5 and the SORN from the seller.

Fixed it up, MoT’d etc.

However I have just found out the guy I got it from hasn’t cleared a LBL loan.

Hence LBL have threatened to come to my house to remove the car, even though it is registered in my name.

If the car is in my garage they will break in to remove it.

I hold my hands up; I was stupid not doing an HPI check.

Do I have a leg to stand on to keep the car?

The seller has moved from where I bought the car. I have his new address and new mobile number. However LBL don’t seem interested in trying to recover from the borrower, merely take the car from me.

The bill of sale was registered 10 days after signing, witnessed by a LBL underwriter.

Again any advice gratefully received.

In April 2008 we swapped a small car for a 7 seater. We done hpi check which was clear. We had logbook it was registered in my name we spent money getting 7 seater through the mot we also taxed the car.

 

On 2nd December 2008 we woke to find the car clamped outside our house. We called the person who had clamped the car, to be told the car belonged to logbook loans not us. We told them we had got the car in April still the said they were taking the car.

 

They came and chucked our personal possession onto the wet grass and drove the car away. We called the police who weren't interested as they said it was a civil matter and nothing to do with them. Our solicitor got in touch with logbook loands and the recovery company. The recovery company said they didn't need to show us any paperwork, court order. They even told us a bailiff was not required to recover the vehicle as it belonged to logbook loans not us. Logbook loans told our solicitor it was there property as the people we got the car from had not paid the loan and they were taking the car .

 

We have a disabled child which is the reason we needed a bigger car, now we are left with no car and have to try and get another.

 

We have our local MP Paddy Tipping helping as well as the daily mirror who will be running our story soon.

 

We are looking to get in touch with people in our position to try and have the law changed as logbook loans are using the bill of sale act 1887 not the newer version which protect third party victims like our selves.

 

Our disabled son is now having his life put at risk everyday just getting to and from school as he has no sense of danger. The rest of the time he is a prisoner in his own home as he is so unsafe you can't take him n public transport.

 

Has anyone checked the cca register to see if logbook loans has a license we have we couldn't find them on the register.

 

Hope to get in touch with other third party victims.

 

Look out for the story in the daily mirror in the next few weeks.

Hi we lost our car to these people about 2 years ago after getting into difficulties. We had paid £10,000 for the car 12 months previously and they sold it for 2300 , we had just been offered 5500 for it and told lbl that we would be paying them off in full and they said this was ok, we owed about 800 in total but the day before the sale was due to take place they came at about 4:30 am to take the car and then after selling the car for a pitance they said we owed them over £400, we were devastated as we really needed the car.

Hi

Having problems with this company at moment. Took out £3500 loan with them 3 months ago. Made 2 payments then lost job. Only missed 1 payment but have now had a letter from them saying I've ignored their request for payment and they are terminating the agreement, and I must pay them £11,375 by the end of this week. Just to reaffirm - I have only missed 1 payment. Not sure whether to laugh or cry - if I can't afford £460 missed monthly payment where do they expect me to get £11375 from? Am I within my rights to hise the car in case they come to take it? Would this then mean they would have to take me to court - I would happily go to court with them. I'm in shock. Got home from work (have new job now) too late to phone them tonight but I'll call them tomorrow. Any advice welcome

Hi im new to this site but need some advice on my LOGBOOK saga, in June this year my husband and myself had no other option but to take out a logbook loan, on the whole the Loan was for just over 900 pounds, we had been paying every week faithfully, but due to other financial commitments we missed a few payments, thus putting us in 236.68 arrears, i phoned lbl and paid 150 towards this also paying 37.00 from the bank the day before, i emailed the company a few times phoned and today i have received a letter DEMANDING full amount as i have 73 pound arrears, stating in the letter that i have no attempt to get in touch, which i have, i also had 37.00 come out the bank today as per debit set up, so they are now demanding 2,113,65 WHAT A LAUGH, i dont know what way to turn now, im not very good with legal jargon, we cant loose our car my son is disabled, and i know i was stupid to go to a company like them but we certainly were not aware of there reputation before hand any advice would be helpful right now and thank you in advance :)

got rid of these monkeys years ago, my 500pound loan finally cost me just under 3000 and 18months. These people are just highway men. think i got about 900 worth of letter charges and phone calls....strange but i never spoke to anyone yet there were 1 or 2 missed calls. Thank fook im shot of these vermin. i now see that the new vermin is payday loan ****.....****** opps wonga is now everywhere.
