Hi,

 

I left South Africa in 2005, I paid my debt whilst in the uk till I lost my job. I struggled to pay the debt and informed my bank back home, they never got back to me, i sent them loads of e-mails and to date had no response to any of them. Anyway my poor mother got a phone call today from some lawyers in south africa claiming I owe about £10 000.00

In debt in South Africa and that I will be listed on the international debt list worldwide and it will affect my credit and bank accounts in the whole world.

She also said that if I do not contact them by Friday the will confiscate my passport when I set foot in South Africa and they will arrest me on the spot.

She also mentioned about cancelling my passport, she said that she sent letters to my previous address in South Africa and have had no response and was told that I no longer live there, then she tracked my mother down and is now harassing her to get into contact with me. I mean when I wanted to speak to my bank 5 years ago they were ignoring me now 6 years later they are harassing my mother. The debt is in my maiden name, can they still chase and will I be liable for this debt still and can I loose my Citizenship in the UK, I am applying for ILTR in March?

 

i have no debt in the UK and have a very good credit record, this is just totally out rageous, I tired contacting them before got igonored and now I am in trouble???

Same answer as above, it's a civil matter not a criminal one.

A debt becomes Statute Barred in most cases after six years, although their are reciprocal agreements between certain countries there has to be a court order in place generally before any action can be taken. It would not be economically viable for them to pursue in the UK.

 

Your mother should refuse to speak to them on the 'phone & if they send any mail she should return it to them unopened marked 'Not Known At This Address'.

 

It will not affect your application for Citizenship. ;)

be the case but I suppose the company

she called from specialises in recoverring

international debt, groenewald lubbe something.

It is just highly annoying that they are

harassing my mother.

well i think they dont have a chance at collecting this one personally the info will not appear on your UK credit file and as others have said it will have no bearing on your application for citizenship. Most of the trash dca's come up with is untrue I doubt they have any legal basis to take your South African passport away. DCA's are full of hot air and most of what they tell you is a lie. I have seen off Aktiv Kapital, Lowell, Red AKA Lowell again, Intrum Justitia and Global Debt Collectors all were saying they will do this that and the other and not one of them had any legal power or basis to do anything in the case of Aktiv and Lowell and Red they were for debts that were not even mine just someone with the same name born in the same year but different date of actual birth. Don't panic is the main thing I paniced at first and made a good few mistakes I know know better you have come to a good place for help.

this out 6 years ago, now they wznt to sort it.

 

hi im going through the same problem!i left south africa bout 3 years ago and i had a family memeber taking over my debt and just found out all this time nothing has been paid!and now im so stressed out and too scared to go back for a visit cos i heard u can be arrested on the airport the minute u land there!im worried if i apply for ILTR it might be a prob!can they follow u for debt?
