Hello,

 

On 19th Nov. 2009 my dad parked in a car park where he wasn't supposed to and this car park was monitered by UKPC.

 

Early December he received a letter informing him of this along with a fine of £45 which as he was going on holiday for 3 months to Russia he paid via cheque (one of the suggested UKPC methods).

 

Dec 27th I arrive to his house (where he's departed) with a final reminder letter informing him that the charge has not been paid and the amount has increased to £90. The letter is dated 14th Dec so I called them, informed them of the situation, informed them that he had sent a cheque off in early Dcember. They informed me that they had received no cheque under the ref number i gave them and due to him being away and no statements arriving yet i couldn't check it however, and they told me to write an email to their department regarding the matter.

I sent the email yet 3 days later we receive a letter in the post (dated 30th Dec) from Debt Recovery Plus LTD informing us that we hadn't paid the initial payment or the final reminder so we were liable to pay £147.50! After speaking to them they informed us that there is nothing they could do but reduced the sum of money down to £136.

 

Few weeks later still no reply, last weekend my dad comes back from Russia, checks his bank account and discovers that the initial cheque of £45 WAS taken out on 9th December. Now we've been left paying £181 all from a £45 fine which shouldn't have been paid in the first place!

We only discovered this recently and i thought before we call them tomorrow morning i'd ask for some advice here.

 

I'm wondering what to do and i want the money back + potentially some form of compensation if possible from the company if possible for the threatening letters from the Debt collection agency.

 

 

All help would be greatly appreciated!

is that all you've paid?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Well, just to make you feel that little bit better, you actually owed them nothing at all. Neither your Dad or you. It is a private car park and thus there is no parking fine, just an unenforecable invoice.

 

Now you have paid this is difficult. How did you pay? If by cash forget it. if by credit card, do a charge back as it is deception to ask you for money that had already been paid. If by debit card do a chargeback, although the banmk will claim it cannot be done, it can.

The first payment was via Cheque and the second was done on a Natwest Maestro card.

 

What would be the best way of going about reclaiming it and is there any way of getting any form of compensation?

but you can certainly get the credit card bit refunded under chargeback scheme [60 days ithink]

What I am trying to highlight is the fact that many people think that the letters from these [problem] companies are proper legal documents and not just toilet paper. Similarly people confuse debt collectors with bailiffs.
