Hello,

 

does anyone know of any templates that i can send to experian. I am trying remove a default notice from carphone. Tried several time with CPW to have no response back from them.

So I want to send experian a letter explain that CPW has not responded to any of my letters and to remove the default.

 

Any ideas please.

There really isn't any need to wait for someone to point out a template. Just write to them saying you dispute the default. Say you've contacted CPW several times (provide dates) but they are just ignoring you. Ask them to remove the default. They won't but should contact CPW. If they don't get a response within a set time then they should remove the default.

Well experian have replied to my email:

Dear *********

 

Thank you for your email, which we received on 27 February 2010.

 

RE: Defaulted account

 

I HAVE REVIEWED OUR RECORDS- AND CAN TELL YOU THAT:

 

- The defaulted account recorded by Carphone Warehouse appears on our records.

 

- We keep defaulted accounts on your report for six years from the date of default. This is true whether or not the debt has been fully repaid.

 

- I can contact Carphone Warehouse on your behalf if you provide me with information as to when you believe the account should not be recorded on your credit report.

I cancelled my mobile contract and CPW did not acknowledge the termination. so carried on charging me. Then they passed it onto several debit collection agents at the same time. I asked CPW for a copy of the signed T&C, to which the didn't send. Whilst this was going on they continued to charge me a monthly contract fee even tho it had expired and i was in dispute. The last DCA stopped after i said that CPW could not produce a signed T&C. Since then CPW have ignored all attempts of communication, so i feel its unjust that they slap a default for an amount that is not correct.

Thanks Craigers, will have a read through that. Hope it does some good because CPW has not responded to any of my letters so far.

I was going to reply to experian with the follow:

 

Thank you for your email, please find below the points of concerns that CPW can not issue a default notice against my good name:

 

 

1. CPW never supplied me with a true signed copy of my credit agreement.(Please see attached email correspondence with a DCA)

2. CPW never sent out a Default warning letter so therefore the correct paperwork procedure wasn't followed.

I feel it has been unjust that CPW can does this without following correct procedures.

Had a reply from experian:

Thank you for your email, which we received on 04 March 2010.

 

RE: Carphone Warehouse Account

 

WHAT I AM DOING FOR YOU:

 

- I am contacting the company concerned for you. This is because I can not amend the information without their consent.

 

- I am adding our standard dispute statement to the entry on your report.

 

"THE CONSUMER HAS DISPUTED THE ACCURACY OF THIS ENTRY AND WE HAVE THEREFORE ASKED THE PROVIDER TO INVESTIGATE IT. GIVEN THAT THIS DATA IS DISPUTED, PLEASE TAKE CARE IF MAKING AN ASSESSMENT OF ANY KIND THAT MAY INCLUDE THIS DATA."

 

- This statement will show within the next seven days.

 

- I will let you know what they say as soon as they reply.

 

 

WHAT I RECOMMEND YOU DO NEXT:

 

- Log in to your report at https://www.creditexpert.co.uk/MCCLogin.aspx to view the dispute statement once the above amendment has taken effect.

What was the outcome?

 

The CRA are waiting for a response which has been over 2 weeks now. I have re emailed both CRA to come back with a response as 2 weeks is long enough for a response.

you say you wrote to cpw tocancel your contract as it run its term and not by recorded delivery and you received no response

 

shooting in the dark but what about the interpretations act

 

What is the interpretations act please?
