my husband recently got pulled over by the police they told him he did not have a driving license. He told them he did he even gave the rough date of when he passed his test. they refused to believe him and prosecuted. we wrote to the dvla who have replied saying they have no record of him at all. he has given various addresses etc but still no record of him. he has in the past had a ban and points so how on earth can there be no record of him. and what do we do

Hi Selina,

it may depend on what the ban was for.Was his licence revoked? Was he ordered to take the test again by the court? If this is the case, and he hasn't taken the test again, then unfortunately he doesn't have a licence to drive. It might worth your while contacting the court who dealt with it.Sorry I can't be more positive for you. I'm still learning here, and hopefully someone more knowledgeable will come along and advise.Let us know how you get on.

hes not sure if he had to take another test as it was such a long time ago but i think i'll ask the court and see what they say thanks for your help

 

Good idea. they are the only ones who should have a definate record of the court ruling.

 

It is surprising how many people get a ban including a re-test instruction, but don't realise about the second bit and just start driving again after the 3 month, 6 month or whatever ban.

His licence may also have been revoked if he did not submit it for points to be added, although both in this case and in the case of a ban I would still expect the DVLA to have some sort of record.

 

You say he passed his test a long time ago, how long ago is it as they may have missed his details in updating his records. Where is his copy of the driving licence?

Have they searched by driv lic number, remember 4 letters from first name then dob in the format y/mm/dd/y so if born 01/02/70 would be called smith would be smit702010....

 

If they can search on part numbers might help.

mines 5 letters of my name then date of birth backwards but i have no idea what dvla have searched, they must know how it works and tried it

 

This is the DVLA remember, I very much doubt they know how it works or have put much effort into trying anything:lol:

 

This is the agency which believes it can write its own laws, ignore other laws which do not suit it and when presented with a licence in full to change a picture or address can proceed to remove entitlements and add on others with no recourse. Remember they are always right even when they are wrong.

 

In my experience if you want the DVLA to do something you have to talk them through it step by step. Common sense is lost in that part of Swansea in the preferance to follow "procedure" or practise.

The driving licence number is made up of 5 letters from your surname, then the date in ymmddy format (although the first digit of the month when it is a zero is sometimes replaced with a 5 for reasons that I know not) then your first 3 initials and 2 final letters that I don't know how they are generated.

 

Any letters that are not applicable are replaced with "9"s
