Hi

 

I received a Parking Notice Charge earlier this week at Aintree retail Park in Liverpool for parking in a disabled bay without a badge. The charge was for £100 reduced to £60.00 if paid within 14 days.

 

My justification for parking there is that I broke my leg in 3 places at the end of November and I am still recovering, also my partner is 8 months pregnant and there was no other spaces available.

 

There were signs posted clearly where I was parked.

 

Please can I have your advice.

Just ignore and do not contact the company. You haven't broken any laws. Blue Badges have no legal standing in private car-parks.

 

In fact it could be argued that by limiting disabled parking spaces to just blue-badge holders constitutes a breach of the DDA. This is because that particular law says that although provision must be made for disabled people in car-parks on private land, no mention is made of limiting this just to blue-badge holders.

I'm just a bit of a worrier and with things being tight financially and my partner being heavily pregnant, I was thinking of just paying up.

 

Thankfully there are sites like this for the common man to get advice!

I've been reading a lot of the posts and threads on here now, and I know the general advice is just to ignore the letters and not to contact them, but I just have a few concerns. Hopefully you can put my mind at ease.

 

1) Would I at any point make contact with

a) UK CPS Ltd

b) The debt collection company

c) the solicitor?

2) If it did go to court and I had not contacted the company, would that go against me?

 

3) Has anyone ever been taken to court and lost?

 

4) If mine was taken to court, what chance do you think I'd have as I did park in front of one of the notification signs which was clearly visible?

 

I know there are lot of posts on here, and I have been through as many as I can without my head exploding :eek:, but they vary in response and the thread age.

what they say and claim is full of " if we , we may , this may happen " like all PPC's they are full of it , until they run out of threats , they dont want to go to court, they have little or nothing to go to court with

The charge is unenforceable, but even so you've done nothing wrong. Blue badges have no status on private land and you were disabled and so used a disabled spot.

 

Ignore the junkmail - they'll give up. You're worrying for no reason.

hi,i have just received a ticket off ukcps for parking in the car park outside b and q.i used to park my van in the trade car park ,but the van kept being damaged ,so i started parking on the bay marked taxi about five years ago which is never used by taxis as they park outside the exit to b and q. the person who issued the fine could not even write the right make of van on the ticket.i rang some smarmy manager from ukcps (name removed),who said he will see me in court .should i pay up or just ignore them, as various treads on this website have advised.thanks.

Just ignore. They won't see you in court because they know they will never win a properly defended case.

Ha ha. We'd love him to, but we all know he wouldn't dare because he doesn't have a legal leg to stand on.

 

By the way it's not a fine, it's actually an unenforceable invoice.

Hi, I also parked in the taxi bay outside b&q aintree today, for the same reasons, Im sick of being doored! I am fuming! I have been down to the police station to seek advice, to see if these so called fines hold the same weight as police or traffic warden fines. Apparently they DONT! The pure cheek of it! I was going to pay until I got on the internet and advice but I tell you now I have no intention of paying! As far as Im concerned, I wasnt obstructing anyone or anything, the pavement is ridiculously high it destroys your wheels and the taxi bay as you said is never used by taxis! Ive spent an absolute fortune on that estate over the years and Im treated like this! You know I wasnt parked on yellows or in a disabled bay I was no harm to anyone! They can try and take me to court! If I had broken the law I would be the first to hold my hands up and say fair do's! But this is a company taking the p.ss! Bullying people! Well it stops here! Dont back down! I work hard for my money and Im NOT gonna give it away! End of!! Sharon.

Hi there... Reading this thread gave me a great laugh! I had to register to voice my opinion on this one! :p

 

I have just been to a retail park myself and knew there were vultures operating there as I actually saw them putting a fine on a car on new years day outside a furniture store when there was literally about 4 cars in the car park (It must hold hundreds!) :eek:

 

Anyway I must have parked slightly over the line on one of the bays (well the line had actually disappeared and was bearly visible as it had not been maintained)... Long story short I come back to a "PARKING NOTICE CHARGE" of £100 from UKCPS (reduced to £60 if I'm total moron and pay now). The first thing I noticed was the unusually high amount of the fine - £100 for being slightly out of a bay that wasn't clearly marked? I think not. :confused:

 

Second thing is how cheap and tacky the notice looked...

 

Third is that UKCPS is 'unable to submit verbal evidence to court... or enter into verbal communication' ... Hmmm :rolleyes:

 

The final straw was - If you want to appeal 'payment must be enclosed with you correspondance and if successful will be refunded in full' ... Laughable. :razz:

 

 

I'm actually really glad this is the case because I wasn't going to pay it either way, I've had enough of the 'fine' culture in this country. Every time you turn around somebody wants to fine you for something. :-x

 

Anyway that's enough of a rant - All I'll say is thanks for the information and for a place to vent my frustration! :D

BUT they cant FINE you nor can any company FINE you either

 

only the council / the police / court of law / Congestion charge / taxman, can fine you , full stop ( IE official bodies only )

 

anyone who put in writting its a FINE other than those that can legally do it , has screwed them self from the start

When I came out ten minutes later there was nothing on my car, but 3 weeks later I get a letter stating I haven't paid my fine and it is now £100. I phoned their number and got the 'pay now and appeal by email otherwise it is an extra £3 a day'. I didn't pay and emailed them to state what had happened. Of course there has been no reply. Today I have received a 2nd reminder notice. I have read the forum with interest, especially the gentleman who went to the police. I am happy to sit it out and see what happens and hopefully they will eventually forget about me! Fingers crossed.

Since neither yellow lines or blue badges have any meaning on private land, they can't do anything.

 

Have never seen a PPC take action against any disabled person anyway. Imagine the PR!

Thanks Billy Bob. No it's not. Been told It'll never get better, but at least I've still got it and got some mobility, a lot if people are worse off, so can't complain. :)

I've had three letters so far and now they have added costs for 'preparing court papers'... lol.

 

I've decided to fight this one by thinking laterally. I have written letters to the Aintree retail stores I regularly visit to tell them I will no longer be shopping there because of the unecessary parking attendants operating on/around their premises, which have caused me much undo stress with a £100 (and rising!) fine. They have lost my business (and anyone else I can make aware) for the foreseeable future, certainly until these parking morons are made redundant. If more people send similar letters I imagine the shop owners will become interested and we will have some useful allies in the fight to get rid of these ridiculous parking companies.

Further to my postings about UK CPS Ltd. I have had two reminders and no answer to my email asking for photographic evidence. I have now had a letter stating that my charge is now £100 plus £50 for preparing court papers. As a gesture of goodwill they will accept £120 as full and final settlement! This letter actually has an address and not a PO Box number.

 

Do I continue to sit it out? They say I have entered a contractual agreement by going on to their premises. I am beginning to feel intimidated. I am disabled and a widow and I do feel bolishy enought that they can take me to court if they want. If they can't be bothered to reply to my initial email they can't say I am ignoring them.

 

Some reassurance please!!!
