I took out a loan with Provident in December last year. I was told at the time that the agent would be in touch to arrange when she would be round to collect payments, however I have not heard a word from an agent and nobody has been round when there has been anyone in. I told them at the time that I worked evenings and that on a Friday night there would be nobody in as my children stay with their dad on that night.

 

I've had letters from them saying that I'm in arrears, even though their agent has never called round as far as I am aware!

 

The credit agreement has the wrong first name on it, it has Amanda and my name is Mandy. I told them countless time that Amanda was not my name but they obviously didn't listen and when I signed the credit agreement I pointed out yet again that my name was wrong on it and was told that it was okay!

 

Is the agreement enforceable if it is in the wrong name? Don't get me wrong I will pay their money if the agent would only appear to collect it, but I am hacked off that they are now starting to hassle me when their agent hasn't even been at my house!

 

I live in Scotland, so not sure if the law is different there when it comes to credit as it is for many other things.
