Hi folks,

 

I've been trying to go through the process of reclaiming my bank charges using the letter templates on here (the one's used before the banks won the trial cases) and I issued my 2nd letter requesting my charges back well over 14 days ago, and to date they've just ignored (presumably) my letter and not responded in any way at all. I have paid off my overdraft and closed the accounts too so i'm trying to get my money back retrospectively (I don't know whether or not this has any bearing on the proceedings). I also just found out today that I no longer have a job, so this money is really needed (it's around £1500 or so). What should I do - redo the second letter using the newer templates, or just issue a court summons to them and also claim hardship too? Any advice would be appreciated,

Hi, Sorry to hear about job, lets hope u get another asap. Anyway I would suggest the following options: -

 

1) Hardship - This is defo an option but only if you are in real hardship & are willing to wait for a decision on that from FOS, I would imagine they are snowed under at mo & would be sometime b4 u get an answer.

 

See if you fit any of the criteria at MSE - you may well do.

The banks definition of hardship differs quite alot to mine. Their view is if you can afford a 6 pack of beer on a Sat then you are fine & livin the high life!

 

2) Court route. If no luck with hardship then I guess the legal route is the only way forward. I wouldn't suggest commencing that just yet though, I would wait just a little bit longer & see what the experts suggest.

 

I believe some work is happening in the background & new guides may come along soon.

 

In answer to your question re closed accounts, this doesn't matter as long as the charges arent from the 90's or something.
