Where do i start. bascially wrote to them using this site asking for charges back after around 6 months of letters they finally gave in and award me £378. But.....they are now telling me to get the money off Lowell as they bought the debt. Wrote to Lowell who have now gone very quiet on me and i cant get a response after sending the letters to both Crapone and Lowell?

 

Any ideas how to preceed?

If this had gone to court then you might have had a chance but imo I dont think you'll get the money off of Lowells, they'll apply it against the balance.

Surely its irrelevant that Lowell now own the debt. Capital One levvied the charges, Lowell had nothing to do with them and have bought the debt for peanuts.

Without seeing it its difficult to give an opinion...

 

And have they purchased the debt in whole or just be assigned it? You can write and demand they pay you in cheque and ask for their final response so you can take it to the FOS, they will most likely side with you on the repaying direct but will not take sides on enforceability.

When I challenged Lowell on the unenforceability of my alleged agreement, mentioned the majority of the debt was made up of unlawful charges and mis-sold ppi, and the default they had registered was unlawful, they promptly said they would try to return the account to the oc (not Crap One) and would not only cease collection activities, they would remove the default too. Get enough ammo and you can get rid of these ****. I'd still hassle Crap One for the refund.

The debt is paid in fully and has been for some time to Lowells. So chase Cap 1 for the refund???
