    • I would think I would have a strong enough claim with regards to him selling the vehicle on a trade sales invoice, at the moment I believe everything else is perhaps irrelevant...    I will keep updated on any progress with TS if they bother to respond and advice given by CAB as and when I hear back,   Thank you again.

    • Yes that’s my point but they keep dismissing it saying the opposite so I don’t know how to argue back. My argument is they did and still are giving me false advice which I took and in turn put me in a worse financial situation.   I have the CCA for this and all DSAR info. This debt is now paid in full

      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
       
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
       
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
       
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
       
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
       
      I’m literally at the end of my tether and don’t know where to turn next !
       
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

Hi there,

recently wrote to the council asking them for all complaints made against their nomitated bailiffs, I asked that they send me the information on this to cover the past year, january 2009-january 2010, all this requested under the Freedom of Information Act.

 

I recieved a call informing me this was not possible as there are some 600.000 accounts they would have to go through and they could not do this.

 

Does this seem right? or should they be able to do it.

They are correct.

 

When setting up our website a few years ago we wrote to approx 100 local authorities to ask the same question and the vast majority confirmed that they received approx 1,2 or at most 3 complaints !!

 

Only now have we been told that this is because UNLESS a complaint is marked as a FORMAL COMPLAINT and addressed to the CHIEF EXECUTIVE it is NOT recorded as such a complaint for FOI purposes. !!!

Thank you for the prompt reply and basicly thats whe he said, most complaints are dealt with without going to the Formal Complaint Route.

 

I did laugh tho when he asked why I was still pursueing my complaint as he felt that the manager of the bailliff conpany wrote a letter explaining all the charges and her views, I explained I asked for a Screenshot and all I got was a letter with her thoughts on what has taken place.

 

He said he cant believe that the bailiffs would add charges if it wasnt leagal, I laughed and asked him if he has ever looked at complaints on the web regarding over charging by by bailliffs and he said he cant comment on it.

If you were pursued by bailiffs, you have a right to a breakdown of costs. This should tell you all you need to know about your own case.

 

If they sent you thousands of case numbers with complaints lodged against them, what use would it be to you?

IT might not be much use to an individual but it would be extremely useful to anyone in the media investigating bailiff abuse!

Of big use, I can take it and pressent it to the bailiff company who say that in the 30 years thay have been in business they have maintained a good reputation and have never gone against the guidlines or added costs that shouldnt be there, so therfore I must be the first they tried to add a £265.50 charge by dropping a letter off with no levy, no wpo done and were comming

back in a week with the REMOVAL CONTRACTOR.

 

So a big use.

OK. But what will that achieve?

 

Look, I don't mean to justify what they do, but I have worked in the industry (not bailiffs, but connected areas) and when people demand info, answers, explanations - they just get them. It doesn't lead anywhere. But hey, it's your time, not mine!

 

If you think they have levied unfairly, get a breakdown, post on here, and if they have, you can take the matter up through the relevant channels. That would be worth doing!

I already am taking it through the relevant channles and as it happens I do have a lot of spare time so will make it a hobby. :D

 

But as already pointed out, they wont send me the information and reasons as to why so end off disscussion realy.
