    • Dear Sir/Madam, TFL case number: **** I would like to thank TFL for providing me the opportunity to explain my behaviour. I realised the stupidity of what I have done and wish to seek a resolution to this matter. I have no valid excuse for this action and I am extremely sorry and deeply regret my action. I hope you will accept my sincere apologies. Nothing can justify my action. I am aware that TFL are only able to operate if everyone pays their fare correctly and I feel so guilty about attempting to breach public trust. This has caused me sleepness nights and raised my anxieties. I have history of anxiety. This has been a hard lesson learnt. I have never been in trouble with the law in the past and I ensure that I won’t be in the future. I am and will be using my oyster card (PAYG). I would like to humbly appeal to TFL to allow me to settle this matter out of court and avoid going to prosecution given the adverse consequences it can have on me and my family. I am very concerned that prosecution for the first time and I would like to make restitution for my action. Having a criminal offense on my record will have detrimental consequences on me. I have always been a law abiding person and have no previous offences. I would really appreciate if I can be given the opportunity to pay for any unpaid fares plus any charges and/or administrative cost which have been incurred by TFL due to this incident. I am sincerely remorseful and ashamed of myself, and I fully appreciate the severity and stupidity of my transgressions. Again, I would like to offer my sincerest apologies. Yours Faithfully, My Name

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

Ok so I have been with A and L since 2005 on what I can only describe as a "under 5's" account, one of the cash card only ones. I hate it but its my own doing and fair enough.

I am a single parent and work part-time. My income is less than £900 a month. Now I like many have had the odd charge to my account for unpaid D/D's. Originally when opened it was for £34 now £25. (both still horredously over charged). Since the Nov decis I have not really bothered about the charges as I had only maybe 6-7 of them. However at the end of nov09 a D/D of £7.45 (milk-man) was rejected as the were insufficient funds in ...I only had £3.67!!!!

This set off a series of D/D defaults and subsequent charges that have snow-balled since. SO since the original on in nov the have taken

NOV-50

DEC-25

JAN-200

FEB-100

As you will see January was a partic tough month, I was forced to sell my L/O pram in order to stop debt spiralling. But this is taking the biscuit. I therefore Fully intend to go all out now. But wanted any advice on my info given... Am I ok to do this?

I have fought and struggled through the last 5 years with debts, at times I have been a mental wreck...This site has provided me and I am sure a lot of others with self empowerment and relief. I have in the last 2 yrs got my life back.

I therefore will not allow this to affect me, when I am not even allowed to use my card in a shop! ha ha

But would appreciate any comments? advice?

Thanks:)

Presumably you have a basic account - is that right?

No O/D, no cheque book - only a cash card - is that right?

Have you got a copy of the T&Cs relating to A&L basic accounts?

OK. Please will you get hold of the basic account T&Cs for your account. Also, have a scout around.

There may be some basic account guidelines and also some guidelines on the BBA website and elsewhere on thsi subject.

Basic accounts have become very ambiguous and maybe it is time we tried to nail it down.

Please come back here when you get the info.

Is their overlimit charge, the "late payment review fee"?

Is this all they say about it in their T&Cs?

As a result of DD defaults, have you also been hit by charges from other companies which were expecting to receive their payments?

this is made unclear.

They imply that its is a "overlimit charge" However they reject the D/D and when they send me the letter regarding the fee they state " there were insuff funds in the account to meet the req payment"

"in accordance with our T&C, a fee of £25 will be deducted from your acc to cover adim costs"

On statements and on my on-line banking they call it Payment reversal fee.

This is all the T & C about basic cash I can find on-line. I will go in branch today.

Luckily not been hit by other charges yet, though have had these D/D re-submitted sometimes 3 days later.
