Confused over statements!

Hi

 

I sent off the SAR last month and got the usual blurb with the £10 back and the statements arrived less than a week later (have to say, im doing the same thing with Halifax at the moment and barclays are winning hands down for speedy service!). However, the statements i have been sent are a little confusing and the money that has been taken by the bank seems to be referred to by 4 different names! Can anybody clarify which ones i can claim back, i have tried looking through various threads but im just getting more confused!

 

The names given against charges are:

- Unpaids out

- Paid referral

- Interest Charged

- Overdraft Fee

 

Any help would be much appreciated as i really want to get my prelim letter off! Thanks in advance!

- Unpaids out (Yes)

- Paid referral (Yes)

- Interest Charged (you can claim the interest on the charges but this can be difficult to work out)

- Overdraft Fee (Believe you cannot claim this as i think this is a service fee for your overdraft probably somebody else can confirm this.)

 

Also look for another word that Barclays use Commission.

 

I decided not to claim the interest as i felt this would more than cover Barclays actual costs, seemed the fair thing to do.

Story So Far:

Pre letter sent 14th August.

Barclays Reply 18th August.

Barclays Reply 5th Sept.

Lba sent 30th August.

Rejection letter sent 9th Sept.

Barclays reply 13th Sept.

Mcol submitted 15/09/2006.

AQ received 21/10/2006.

AQ returned 23 /10/2006.

Court Date:25/01/07 10.30am

Phoned Barclays 08/01/07 Said they would contact me shortly.

15/01/07 Received letter offering a full settlement however figure was short.

22/01/07 Received telephone call from Barclays asking for a settlement figure.

CLAIM SETTLED IN FULL!!!!!!!!!

Quick point, when i say Interest Charged it literally says on the statement, Interest Charged and then has an amount taken from the account, usually on the same date as the overdraft fee?

 

Any one have any advice on this? And on the issue of claiming Overdraft Fee's back?

Not too sure where to go with this now.

The overdraft fee's and unauthorised overdraft fee (surely just a rewording) vary from £5 to £20, even if the overdraft was our fault this is surely a lot to be paying. And as there is no need to work out the interest charged as it is on the statements im not sure what to do!

Hi Julie I dont think you can claim all the interest, only the part that was charged on the illegal charges,also the overdraft fee is a business charge that you will have agreed to when taking out an overdraft.To work out what interest to charge use Vampiress's spreadsheets (very good ) from the templates library

Thanks for the advice, its me getting in a flap as i need to get this done and printed out today!

Any advice on the overdraft fee part from any mods?

Yes, I wonder if it is, as the statements show that I was charged an overdraft fee, which is reasonable, then interest, and ontop of that I am charged £20.00 a throw for unauthorised OD fee, that can't be right can it?

Sorry for the long time between posts but ive been away. When i sent off my Prelim with the statement of charges i put in everything i thought should be included as everyone seems to ahve different opinions. This included the overdraft fee. I have received the standard letter back " we are dealing with your complaint you will have a response within 4 weeks, etc"

Now im just waiting for the 14 days to be up to send my LBA

Historically, Barclays used to charge a monthly fee to customers who had an agreed overdraft facility. I don't know when this was scrapped (long before my time) but I do know that before it was scrapped, it was £5 per month. Therefore, I feel it is unlikely that you will be able to claim this back, as it wasn't a penelty. However, if the amount was £20 then this must refer to an unauthorised overdraft fee, which is chargable.

Ok, after all the confusion in this thread my battle continues. I have now received an offer from barclays for £450 (claim is for £1000). Received it the day before i was going to post my LBA! Rewriting the LBA now to accept it is a partial payment and continue the battle for the rest of my money, although i dont think they will raise the offer without a claim.

Ok, if anyone could give me some advise i would be very grateful! Not to bore you with details but due to personal probs all this had to take a back seat for a while. I havent contacted Barclays since i declined the partial offer on 19/9 and am yet to send the LBA. am i ok to just send the LBA or do i need to start further back again?
