    • Dear Sir/Madam, TFL case number: **** I would like to thank TFL for providing me the opportunity to explain my behaviour. I realised the stupidity of what I have done and wish to seek a resolution to this matter. I have no valid excuse for this action and I am extremely sorry and deeply regret my action. I hope you will accept my sincere apologies. Nothing can justify my action. I am aware that TFL are only able to operate if everyone pays their fare correctly and I feel so guilty about attempting to breach public trust. This has caused me sleepness nights and raised my anxieties. I have history of anxiety. This has been a hard lesson learnt. I have never been in trouble with the law in the past and I ensure that I won’t be in the future. I am and will be using my oyster card (PAYG). I would like to humbly appeal to TFL to allow me to settle this matter out of court and avoid going to prosecution given the adverse consequences it can have on me and my family. I am very concerned that prosecution for the first time and I would like to make restitution for my action. Having a criminal offense on my record will have detrimental consequences on me. I have always been a law abiding person and have no previous offences. I would really appreciate if I can be given the opportunity to pay for any unpaid fares plus any charges and/or administrative cost which have been incurred by TFL due to this incident.     • use the webform if it allows you to attach your evidential documents then do so but do that later depending upon who your bank is.... - but i suspect you will be referred to Mastercard. who is your bank? dx    
    • If i did it through the bank, they seem to have an online form. I wondered if this is the best way or to do a letter, add supporting documents and send them through the post, recorded delivery  ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Your story is certainly not without merits-of course make up falls through supermarket trolleys like may things which are flat packed and shrink wrapped.

As far as I am aware,we havent had reports about this company you speak of,but will be looking closely at them.

When we first started this forum (I am moving to there )

We were inunidated by victims of RLP.

Over the last year or more,we have seen an increasing amount of activity with more of the same come into the frame.

Remarkably this bears striking resemblance to the ways in which RLP are operating,although the fees demanded are lower.

No doubt you will get response here.

Our advice as always is that if you believe that you were not responsible nor a party to fraud,theft,or deception from Tesco,then you should not part with any money.

No doubt you have already read many other posts advising of the same.

An initial search of the Consumer Credit Licence database shows no licence for any business with the postcode of E4 0BN.

This is not to say they dont have one,updating of records can take weeks or even months.

The Office of Fair Trading will be able to clarify if they are licenced.

It is an offence for a business to be engaged in any such activities unless they are licenced.

I will be following this up with the OFT.

The OFT public register for CCLs show a terminated licence that gives the same address and postcode as that now being used by Civil Recovery Ltd.

There is no suggestion nor allegation put forward that this is the same company,but it is merely to show that a licence was formerly in place and registered to this address.

Triton the best advice I can give you is to read the previous threads especially those related to RLP and it will become clear what your options are. The posts that I have removed related to information that will be helpful to the group as a whole but on reflection I need to check with others before posting this information.

 

The address of Civil Recovery Ltd is the same address used by Total Security Solutions. This company perform car clamping services.

Having done a search of both ICO and CCL database there does not appear to be any entries against the postcode E11 1GA.

As said previously,it does not mean that no licences exist,it could be that the database for these entries have yet to be updated to include them.

Will be seeking clarification though on Monday.

Ok will do, thanks. I honestly don't know what to do, if I don't respond to civil recovery in the 21 day period obviously the amount goes up, and does the amount keep going up if I choose to ignore them? Like I previously said the police weren't taking it any further, so eventually if I went to court (if civil recovery takes me to court) surely the police dismissed it, would the court??

Triton I can only advise that you read up on other threads here,which give CAGs position on this.

Of course they may well increase their demands for payment from you.

The introductory invitation is designed to get you to pay immediately.

Irrespective of whether the amount is £1 or £1000 the fact remains that you have not been convicted of any crime by a Court of Law,They have not justified the fees they claim are due to be proportionate,they have not proved that you are liable,and they have acted not in the interests of crime prevention,but in consideration of profit for themselves.

The Leytonstone House address is used by many companies as their registered office - it's probably an accountant acting as company secretary.

 

The company was registered at Companies House in March 2009 - no. 6864468. The company number should be shown, by law, on all stationery.

 

The E4 address resolves to a residential street of small, modern terrace houses, so this is probably run from home.

 

I couldn't search the OFT register (I'm on the world's slowest satellite link in the middle of a desert, and it just times out), but it may be worth searching again.

 

None of the companies involved in civil recovery seem to have much appetite for actually going to court, with the exception of Drydens, who have won a few cases by default, most of them involving theft by shop staff. I suspect that this company has jumped on the bandwagon, and that the East London simians behind it will be too busy with their clamping business to do anything more than send out threat letters.

 

Still, they are worth further investigation. What was the postmark on the envelope? Was it franked or did it have a stamp? It would be interesting to see a scan of the letter (suitably scrubbed).

 

I have no doubt that JonCris will keep our mutual civil-recovery watching friends informed.

Thanks for your reply & taking time out to look at my problem. I've not got the envelope but I'm sure it was a stamp. I haven't got a scanner so I'm sorry I can't show you the letter, it seems to me that companies or just anyone are jumping on the bandwagon & thinking lets start our own civil recovery company, before we know it the UK will have thousands of them!!

Triton - please read both the CAB report on civil recovery (stickied in this forum), and some of the other threads. You will see that a company being 'above board' does not mean that their claims are legitimate or that they will do anything other than send letters. There is no reason whatever to pay them.

 

Martin: Try searching the company number, and the postcode E4 0BN - the Leytonstone address isn't helpful. I suspect, however, that there is no licence, either because the company hasn't bothered to get one, or it has followed RLP's idea that it doesn't need one (though RLP, of course, applied for one shortly after Nottingham Trading Standards contacted them after I complained...).

I am overseas at the moment. I cannot say exactly where, but you can probably guess.

 

Hint: there aren't enough helicopters here, despite what Cyclops says.

 

CAG has operators everywhere! I'm just practicing for some spec-ops against DCAs when I get back...
