    • I can only speak from personal experience. But a similar thing happened to me. Seriously dented door.  I made the other insurance pay. They regarded it as a write off. Took the money, replaced the door. Never heard anything more about it.    Except clearly someone sold my details to claims company, because I got loads of calls in bad English for a few month's 
    • The incident was 03rd March 2024 - and that was the only letter that I have received from MET 15th April 2024 The charge I paid was at the Stansted Airport exit gate (No real relevance now - I thought this charge was for that!!).   Here is the content of email to them (Yes I know I said I was the driver !!!!) as said above -  I thought this charge was for that!! "Stansted Airport" Dear “To whom it may concern” My name is ??  PCN:  ?? Veh Reg: Date of Incident: 03rd March 2024 I have just received a parking charge final reminder letter, dated 10th April 2024 - for an overstay.  This is the first to my knowledge of any overstay. I am aware that I am out of the 28 days, I don’t mean to be rude, this feels like it is a scam My movements on this day in question are, I pulled into what looked like a service station on my way to pick my daughter and family up from Stansted airport. The reason for me pulling into this area was to use a toilet, so I found Starbucks, and when into there, after the above, I then purchased a coffee. After which I then continued with my journey to pick my daughter up. (however after I sent this email I remember that Starbucks was closed so I then I walked over to Macdonalds) There was no signs about parking or any tickets machines to explains about the parking rules. Once at Stansted, I entered and then paid on exit.  So Im not show where I overstayed my welcome.. With gratitude    
    • Just to enlarge on Dave's great rundown of your case under Penalty. In the oft quoted case often seen on PCNs,  viz PE v Beavis while to Judges said there was a case for claiming that £100 was a penalty, this was overruled in this case because PE had a legitimate interest in keeping the car park free for other motorists which outweighed the penalty. Here there is no legitimate interest since the premises were closed. Therefore the charge is a penalty and the case should be thrown out for that reason alone.   The Appeals dept need informing about what and what isn't a valid PCN. Dummies. You should also mention that you were unable to pay by Iphone as there was no internet connection and there was a long  queue to pay on a very busy day . There was no facility for us to pay from the time of our arrival only the time from when we paid at the machine so we felt that was a bit of a scam since we were not parked until we paid. On top of that we had two children to load and unload in the car which should be taken into account since Consideration periods and Grace periods are minimum time. If you weren't the driver and PoFA isn't compliant you are off scot free since only the driver is liable and they are saying it was you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Here is the dilema. I recently bought a Corsa diesel with 89k on the clock. Full history, well almost. Was due a service.

 

Now, I always do my own servicing but as this car has a full history I wanted a Masterfit quickie service. Basically an oil and filter change and book stamped with the nice Griffin.

 

So, I ring my local Evans Halshaw Vauxhall Stealership. Can they do it? Yes. What will I get? Just oil syphoned out, new oil filter, new oil, one stamp in the book. Great, how much? £69.95 +Vat!

 

After I got back off the floor and contained my side splitting hysterics I said.... 'No, really.... how much'.

 

I do not see that I will be adding £70 to the value of the car (cost £2k and worth £2,750), so stuff them. Literally a 10 minute job and when I do it, the sump polug comes out to get all the crap out before adding nice new oil.

 

Having a laugh!:shock:

Hey Jimmy,

 

When your service goes mamory up, do you write to yourself, phone TS and complain about yourself, threaten SOGA or blame the dog barking? :D

 

Seriously though, they make huge money on the oil which you can buy for a third if not less through a factor and the filter the same. And as regards syphoning it out.......well it's easier usually to drop the polug as you say.

As an Ex Evans Halshaw employee in the accounts department of the local Renault dealership (now hanging head in shame)

 

When I was there 2 years ago, I know that EH charged out labour at £32.50 the hour!!!

 

The mechanics were paid £8.50 the hour (hubby was there at the same time)

 

I was embarrassed looking at some of the invoices from suppliers and knowing what the charged out to customers.

I do understand that the big stealers have very expensive showrooms and lots of staff, someone has to pay for thet - it just won't be me.

 

Yes, I do replace the sump washer. I have a pack of 20 I bought a year or so ago.

 

I buy the oil from vauxhall when they have their 4 for the price of 3 offer on. Works out at about £6 a gallon.

 

Lol at Helios. Yep, I write myself a stern letter. I am very methodical with my servicing. Brake fluid has just been replaced completely as dispite the fact that the car is 5 years old and has a full Vauxhall history, the brake fluid was still the original! You and I know 2 years max and change it.

 

Interestingly they have changed the cambelt - which is difficult on a 1.3 CDTi Vauxhall as they have a chain (not cambelt), and it is the original one still.

Im getting very concerned about your servicing technique Jimmy!

 

For a start you probably used seat covers and floor mats, you probably delivered the job on time and to the price you quoted yourself, I doubt if you left the obligitory service signature of a greasy paw mark over the bonnet or wing and I doubt that you changed the radio frequency to Funky FM. Further you have not supplied an open ended list of totally unneccessary repairs needed which needs a mortgage to fix. To compound it, you did not take the car for a blast past a school at 70mph to get yourself a speeding ticket three months after the event and you probably recorded what you had done in the service book.

 

The next thing is I expect you will take full responsibility for the work you have done in creating more problems.

 

This is totally against the aftermarket car industry ethics that exist and you should be thoroughly ashamed of yourself. Shoddy work in deed. I'm appalled.:eek:

 

AND, you had the audacity to realise the brake fluid needed changing and worked out the difference between a cam belt and chain.

 

You could trigger a National Strike here!!

 

What next?

I must confess, I did leave the rear wheel nuts loose once on a Fiat 124 I had. This was in 1979 and I found out when the back wheel fell off as I tried to turn right on a very busy high street. The funny part was the ratlling sound for the previous 2-3 miles as each wheel nut fell into the steel hub cap they had back then.

 

I did also once not bother with the pollen filter as I forgot to buy it. I didn't tell myself about it so I didn't complain. :rolleyes:

 

I also dropped an 8mm socket down the side of the engine and wing once and couldn't get it out. So it stayed there. Does that count at all?

 

Trying to be reallly bad now!:-x:shock::D

Well Jimmy I think you have redeemed yourself with an A+ 3 star rating as a Fast fit fitter.

 

You got A+ because I think the 124 had bolts at that time, a star for forgetting to follow process and a star for dropping the socket. Plus trying to convince us you tried to replace the pollen filter but forgot

 

You could have got 5 stars but lost two :

1 star for admitting it and not blaming Donald Duck and the second for not coming up with a more imaginative excuse as to excuse liability, such as "our quality manager took it for a test drive over the reactor at Chenobyl and the nuts were ok then, the fact they changed into bolts and glow in the dark is not our responsibility".

 

So Jimmy, despite your confession, you need just a little bit more!!!:)
