Hi all. Just a short question...capquest are asking for proof of mine and my husbands benefits. Do you think this is a good idea and do they actually need this information?

Any advice would be grateful.

They are not entitled to any such information and under no curcumstances give it to them

 

Only a court can order the disclosure of such information.

 

Never give a DCA proof of anything.

When i first got into fincial difficulties a few years ago. i sent all my creditors a copy of my pension credits letter. They all still wanted me to give them all my money so now they get a £1 a month and no more private info.

 

I certainly wouldn't tell them of any other benefits you get such as DLA, I have found telling them you have disabilities only makes them more agressive hoping to break you.

Thanks for your reply. I have been negotiating with capquest regarding a loan with tesco that I could no longer afford the original payments. I can no longer afford any payments due to my husband being unable to work becuase of his health. I stay home to look after my young son and my husband. I have explained this in a letter to capquest but they want me to fill in their income/expenditure form. I have already sent them a budget sheet which I download from National debtline. They tend to ignore what I am saying to them!!

Have you sent a CCA requst to them yet? If not, write to them for a copy of the Credit Agreement. You'll find a template letter here:

Send off a £1 postal order with the letter. They then have 12 + 2 days to send it to you. If they do send something back, scan it, remove your personal details, and post it here.

 

Standard advice - Never speak to them on the phone, they are experts at bullying people into paying, whether the alleged debt is real or not. Send all letters by recorded delivery in case they "lose" them. Do not sign letters, just print your name, so that they can't get creative with Photoshop.

And if they or any other DCA sends you an I&E form to fill in and send back, just fill it full of zero's.

These DCA's seem to think they have some sort of god given right to peoples personal and private information, and then have the audacity to tell you how much they want!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

That's because disability benefits have an exemption in the repayment calculations of unsecured debt in most circumstances, provided you didn't get the credit in the first place on the strength of that income.

 

If a significant percentage of your income is from disability or pension benefits, a DJ in the right frame of mind would be inclined to write the debt off, in the highly unlikely event a DCA took court action. Probably worst case scenario is an order to pay a couple of quid a week. Not worth a DCA's while and they know that, hence the pressure to get as much as possible as quickly as possible by applying pressure.

 

The same applies to debts owed to DWP. In most case they will automatically deduct owed monies from any benefit you receive by following a set formula - with the exception of some disability benefits due to the nature of the hardship element of eligibibilty to receive it in the first place. Recent stories of Iraq/Afghan veterans being penalised have put this back in the news, but although most disability benefits are definitely exempt, compensation payouts may not be, but that's a different story.

 

If in the unlikely event you do get a CCJ whilst receiving disability benefits, it would probably be a good idea to apply to the issuing court for an Administration Order, providing your total outstanding debts are less than 5K(?). That really does P... off the DCA's....they won't touch you with a poopy stick in those circumstances.

Thanks Dannyboy. Unfortunately our debts are more than £5k! Have been looking into all sorts of ways of repaying but Im offering no token payments at present as there just isnt enough money to cover it. Will see what happens. I do not own a home or have any assets.

Good, you are on the right track. DLA is protected income and courts wont touch it. DCA's know that. I've been there and got the T Shirt. Don't let them brow beat you on the telephone into parting with anything more than a pound a month worse case scenario. Have they provided valid CCA's yet?

To be honest I havent asked for CCA. All I seem to do is write letters (we have 8 creditors in all) and I have read of the hassle it can be to get these company's to comply. I know that sounds lame but it is all getting us down a bit.

Have you considered asking the company to write off the balance due to no prospect of paying it back?

well i would advise them then that until your circumstances change no payment would be made. Then pay off what you can towards smaller loans to build up money.

they might not like it or believe it but they wont get much option if you have nothing.
