I have just left work on Maternity pay with a new baby born November 2009 and I tried to claim Family Tax Credit.

 

HMRC want to assess my income I earned last year, 29K a year, but as I am raising little'un, I am only earning £117 a week.

 

Its seems unfair for my tax credits to be based on my last years earnings when I’m only earning £117 a week.

 

Can HMRC really do this?

Yes, they base it on the previous year's income but they can then do a reassessment for someone on your circumstances. Once you are awarded it, you call them up and give them an estimate of your earnings for the current tax year. As they are significantly lower, they can reassess. Whilst you are receiving SMP, they disregard the first £100 per week - make sure you tell them it is SMP.

Erika is right - though you earned 29K last year but now you are on SMP.

 

Do you have a partner? Is he working? or you are a lone parent.
