Hi

I just came across this site yesterday and have printed out the S.A.R - (Subject Access Request) letter but I think I need to change it to include my credit card acc. no.

 

I also have a personal loan from Halifax. Can someone tell me if any refund offered will be put towards my loan or my overdraft which is currently at its £1200 limit.

 

I should point out that I am currently paying off my loan along with my credit card, Capital One credit card and Cahoot overdraft with the help of CCCS.

 

From reading this section I get the impression that Halifax seem to be quite keen on defending their charges or is this just a scare tactic hoping that people will drop their claims or accept the small offer they make. I don't know how they can defend making two charges even if you only go into the red once. I'm sure you know the charges I mean. Anyway they needn't think they can scare me off with the threat of court action.

 

I look forward to getting my hands on the (sorry, my) money.

 

Have to say this site is great full of helpful information. i'll hopefully get round to reading some of the other topics soon. Keep up the good work.

Welcome to the site.

ALL the banks are defending their charges as just.......not only Halifax.

You have the right to ask that your refund be made by cheque,although it is standard procedure for them to put refunds into live accounts.

 

Take some time to read the experiences of halifax claimants,there are a lot of them !!

Forgot to mention that I went over my agreed overdraft limit by £2 a few days ago and guess what, I haven't received a notification of charges letter (yet). I usually get one online the day after.

Hi. Well after all this time I finally got around to taking the first step and sent of the S.A.R - (Subject Access Request) letter on Saturday.One thing I didn't do and that was to put the date on the cheque but I hope this won't matter..

 

One question I have is: I am always overdrawn, and therefore always paying interest,(I have a £1200 overdraft) and was before I started accumilating charges. So how do I know or work out the interest that applies to the times when I exceeded my overdraft limit

 

Just think, if I had got my finger out when I first joined this site then I good have had a great christmas. But hopefully it will be all sorted before I ave to put my car throug the MOT in April.

 

Just as a matter of interest. I just renewed my car insurance and I pay monthly instalments via a company called premium credit. They make a charge of £20 if a DD payment is missed. Is this also classed as unlawful or is it a different matter altogther. It was only one or two payments I missed in the past and their repayment rates are very reasonable so its probably not worth rocking the boat on this one anyway.

Received this from HBOS today.,

 

Dear sir/madam

 

Completion of request for a list of transactions and charges - XXXXXXX

 

Thank you for your letter requesting specific information on your account with us. I can confirm that copies of duplicate statements have been ordered and will be sent under seperate cover.

 

Now this is the bit i'm not sure about.

 

With regard to your request for information relating to manual intervention on your account, HBOS is under no statutory obligation to record this information and therefore, I am unable to assist further with your request.

 

Then it goes on to point me to the website and phone number for further information.

I may be wrong here but I seem to remember one or two threads mentioning been supplied with information on manual intervention.

 

It remains to be seen now if these statements arrive on time. I work it out as been 25th or 26th of February as the deadline (signed for on 16/01).

21 days and counting. Hopefully I will receive my statements well before the 40 days are up.

 

I am curious to know, is this investigation by the OFT causing the banks to pay up any quicker, or are they holding out to see how much of our money they are allowed to keep?

I've just had a letter from Uncle Ken. He tells me that if I don't get my statements within 10 days to phone him!:roll:

 

don't worry about what to do - the folk on this site are extremely supportive, you will succeed, and will get your penalty charges back.

 

just keep on wqith the posting - in reply to your query with the OFT - the Halilaffs isn't really consitent - my daughter has had an offer before me and I sent her SAR at the same time as me, all I've had is an acknowledgement.....:?

 

Keep up with it - you will win

Halifax - paid out without getting to court - £250 WON - no intention of going, stated too costly!!

Halifax no 2 account - paid out without a fight - (by mistake, £1650 - should have been £1200 - had to pay some back)

Received my statements yesterday (84 pages in all) and the first check of them comes to £2,176. I would love to add the contractual interest but the spreadsheet looks way to complicated and time consuming to me.

 

Are Halifax just been awkward here. Each envelope contained five pages, three were folded together as were the other two. Maybe it was too much for them to think of just folding the five pages together.

 

I havejust one question. I incurred a £39 charge on 4/1 so I will have another £28 at te end of this month. AmI right in tinking that I can just add this £28 at a later stage.

 

I've started looking through Autotrader already.

yes you can lets hope they stop adding them, the story will go on and on and on.

Dont forget you can only add them on until you file at court, up till then add everything...!:D

Sent off my prelim. letter yesterday. This time I sent it to customer relations in Halifax. Hopefully this is the right place.

 

I'm going to be generous and wait for the letter to be signed for before counting the 14 days.

 

I'm undecided wether I want a swift conclusion to this (get it over and done with) or let it get to the court stage so I can start adding interest lol.

You might not get the info it has been signed. No need to be generous, because you can gaurentee they wont be grateful. Start counting from tomorrow. :D

Not too sure what ss lady means by this- does it mean that you can only add up the £30 charges until you file at court? I have added up all my charges on my statements and used this figure as the amount (minus interest) on the LBA. Is this correct? im quite confused!

Sorry if i have confused you.

 

What i mean is if there is a charge on your statement then you can add it to your spread sheet. £10, £12 £15,£28 £39 whatever it says.

 

If you get any more charges now, you can keep adding them on to the spread sheets, but only until it reaches the court stage. Once filed you cant add any more on.

 

What you have done is right.

Hi - good luck with the Halifax. I successfully claimed from them earlier in the year, with them settling the full amount of £2281, after only two letters and a phone call :D :D :D

 

Have a read of my thread to see my timescales!!

 

From reading different threads around the forum, Halifax do seem to be one of the better ones for settling early. It must be something to do with "who gives you xtra" !!!!

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Really could do with some advice on this. If I send another copy will this only make matters worse/look like I dont know what i'm doing? Will they respond anyway?

hi djgordy - I dont think that signing the letter is too important at the moment. It does not mean that the letter isnt legally recognised. It could be a bit embarracing if the letter ends up being used if your claim goes to the small claims court.

 

If anyone else has any experience of this matter in small claims they may be able to offer more input?

 

I got a letter through today from halifax 14 days after my LBA offering me £1800 of my total claim of £2500 - so dont worry! the banks are in the wrong here not you! please dont lose sleep over a signature..
