Thanks lowdown. I thought that was the case, but,when Moordown told me they didn't need one (they would say that, wouldn't they?)

 

If they cannot supply the required paperwork, the debt is unenforceable. Then more than likely sent back to BPF, and they will try some other DCA, and on it goes.The DOA and the CCA have to be sent to you on your request.If they do not send them to you, they do not have them - Simple really.

I have recently posted my letters to my MP but as yet have had no reply whatsoever! :|

 

I have also had Mrs A Lyness's little yellow card (which I ignored) and tonight had a phone call from Allied International. I refused to do their security checks though as I told them I didn't know who they were so they just gave up in the end. 8-) I will now send them the template letter as suggested - thanks guys!

 

On a slightly happier note - I am about to get the keys for my new house this week. Although BPF trying to sully my credit rating with several months payments behind, I added my comments when they first started and managed to get a mortgage despite them. Ha! :razz:

 

Just need the legal team to squash them in court now and end this nightmare once and for all. Thanks so much to Fuzz and all who have been consistently offering help and encouragement to the rest of us despairing souls. Hang on in there guys!!

 

Good to hear some postive news here its been getting a little slow.

 

I also had an alert from my experian account and Clydesdale have now clocked up 5 late payment notices, I like you have left a notice of correction on my account, though I must admit that by now many companies in the banking industry must know about the situation with BPF and its customers so as long as these companies have the info upfront they can see for themselves what is being done by BPF to its own customers.. because that is what we are at the end of the day we are not enemies of BPF we are customers it is they who instigated the situation and expected us to put up with their decision without any discussion or by our permission the have single handedly created this whole sceanario and it just shows what they think of the customers.

 

I have just had a situation with Npower its been over 5 years since they fitted a new electronic meter and since that time they only billed me with estimates and electric bills.. they even gave me money back!! and I repeatedly called them to give cutomer readings and quiery my bills this was as well as their own meter readers who came.

after nearly 5 years of estimates and phone calls and finally they realised what I was trying to tell them, they froze my account and toted up how much electric they thought I had used, I have a letter from them with itemised billing and they have written off thousands (more than the BPF loan) and given me a bill of £600 which I consider more than reasonable.. though now I have to take them to task about the electronic meter I dont think it reads correctly (my original complaint) :(

 

my point is compare the actions of these two companies towards their customers.. one wants to bleed you to death despite their actions... the other is bending over to help to put right a situation they created

I just got back to the UK and I have those letters from that company including the yellow one, also a letter from BPF telling me they have instructed that company to reclaim their money.

No info on re-assignment or anything else.

 

What have I missed in the past month guys with this latest round.. and any other news??

STAY STRONG PEOPLE!!! lets not give into these bullies.

 

I Just recieved a NOTICE OF POSSIBLE LITIGATION from Moorcroft, i have told them the account is in dispute, im not happy with my service as my IT company went bust (which Barclays conveniently left out) they are going to contact Barclays and prob come back with some with all sorts of rubbish from Barclays. Now to wait......

 

If Barclays does succeed, im going bankrupt

maybe its just me but i have not had any phone calls or letters or any sort of communication from

barclays or any of there other pimps for months now!

I was thinking the same thing but now a secondary debt collection agency requesting money from me..... there is a lot of people to go round, maybe they are doing it alphabetically or something lol

I have heard nothing since the start of September when Mercers sent me a demand. I didn't bother to reply so maybe they have given up:smile:. I doubt it though. I just want Barclays to sort out the mess they have made of my credit score.

What i cant understand is..we signed a contract with Advent...they went bust..our provider found a "new" or alternative provider fair enough. WHY then are we obliged to take this new facility? Does it say in section 75 that we have no choice? no say? After all..its our money and we chose to invest in Advent, not Computeach! I recieved my fos letter before, and yet again theyre reluctant to continue my claim..idiots! Im just going to continue annoying them with more letters for the sake of it. Hope Hausfield sort this out for us and we get our money back!

Hey all. I contacted Allied international today seen as id missed 3 calls. I wasnt going to call them but thought id just see what they said. So anyway spoke to one of their people he asked why i wouldnt pay so I told him. He said they didnt get told what the debt was for just that i was in arrears. I told them about legal action thats ongoing and he has put my account on hold. All he asked was that I keep in contact when I get an update from legal team. He was polite about it. Just need to see what happens next. Any news Fuzz

Interesting reading coming from some of you, i was an advent student then given alternative training with computeach... then to my horror sent an e-mail today explaining that my course has expired with computeach and if i wanted to carry on my studies i would have to pay £140 a month for 12 months... surely my contract with BPF should have catered for my entire course duration, no matter how long it takes... as it stated in contractural agreement with BPF that they would HAVE to find an alternative training provider for me to COMPLETE my course, not suddenly expire with computeach and for them to start demanding money for me carry on.

 

I feel i should stop making payments immediatly.

Yeah this is one of the main grievances everyone has, that the alternative course is not like for in terms and conditions and is therefore a breach of section 75. E-mail Fuzzbutt for details on how to raise hell.

FUZZBUTT UPDATE: Sorry there's not been any news from me - I know a lot of people are anxious to know what's happening.

Hausfeld are still working with Barclays and there has been some positive steps but nothing concrete I can report at the moment. I hope to have more very soon.

 

I've personally asked FOS to release me the documents BPF sent them to justify their position, so that I may challenge what was said. Unfortunately, FOS aren't obliged to do this under the Freedom of Information Act but the adjudicator did promise to ask Barclays if this was possible (they need their permission!). More wasted time.

Our lawyer is aware of all these manouvers.

Perhaps everyone who has had a refusal by FOS should complain and demand to see the evidence BPF supplied that led to their decision. Please copy to Hausfeld if you get anything.

I've just been reading through the last 2 pages and have flagged up to our lawyer this latest assault by BPF, using multiple debt collection agencies without Deed of Assignment letter. I don't know if it's illegal or not, but it certainly illustrates what an faceless, ruthless and incompetent bunch of idiots Barclays Partner Finance directors are! :mad2:

Hello fuzz.... thankyou for all the hardwork and the update, just curious, can we use the fact that Barclays cut the funding for Advent which was basically why they went bust and that we're not using Computeach for that same reason. Its the recession and there is not a lot of stability at the moment

Probably we should focus more on why did Advent go bust, in the first place. That is the root of our problem and there might be the answer. If it went bust because of lack of funding then it would have meant that almost any of the 6000 students (or the majority) signed up with BPF. Wasn't there a legal relation between Barclays and Advent that would have committed Barclays to fund the Provider on our behalf?

At the time when I first contacted Barclays partner finance I was told that they had over 6,000 in same situation as me, and that they had given the money up front to Advent, either he was telling lies or the money that was given was syphoned off by the directors who left just enough in the company to keep it going or Advent was in a similar situtation to Computeach who at the moment are running with a large negative -£2.4 .

I noticed on the creditor report that was sent by PKF, that barclays name was nowhere on the documents.. strange since they had so many students with the partnership loans??.

 

the money either was not given.. or was was wasted... either way.. we are not to blame!!!!

Hi guys just got my letter from FOS and it is same old rubbish saying that BPF have indeed found a suitable supplier. You have to wonder what this organisation acctually does? They appear to be quite toothless in all their actions. Anyway I intend to appeal against this decision, and will be sending them a fair number of letters.

I've just recieved a second confirmation from the FOS that my complaint isnt upheld, so I will not ask them for what evidence BPF/Computeach provided so he could come to this decision.

 

I'm more than sure that Barclays Partner Finance and Computeach have seen everything I have sent through as part of the so called investigation the Financial Ombudsman Service has apparently done.

has anyone else had the letter from Barclays Partner Finance saying they have instructed a specialised debt recovery agency.. ie Moorcroft ?

 

I was just writing my letter to BPF to complain about their latest actions when I noticed on the letter.. it has no name just states collections department.. and the signature is a unrecognisable scribble.. yet again BPF fear to stick their neck out with names that can be used

Our lawyer has asked me to make people aware that, if they are still getting harassment from any debt collection agency to please contact their local Citizens Advice Bureau, NOT Hausfeld. The legal team are unable to represent individuals in this case and are just e-directing people to CAB, who can offer free legal, immediate help.

Hi, Ive posted the same thing now and im getting rearlly fustrated now. Im one of the unlucky ones who got a guarentor to sign my contract for me, and Im now lost on where to go. Can someone please give me some possible options on what I can do now as I know sec 75 doesnt cover me now. Im not willing to make a claim to be a unsecured creditor with Advent, as im going to get nothing back. Computeach will only con me when I sign up for them as I had 4 weeks left on my course end date, and after i sign they will then ask for monthy payments. So im king of screwed paying back this loan.

 

Can anyone help at all as im not the only one in this situation with regards to the guarentors, so if somebody on here in the same situation as me, can you reply and advise what is the best course of action.

Have you asked BPF for a copy of their signed agreement with you? [they have to provide it]

Its seems they are having trouble providing one for some students.This route does not mean the loan will be overturned....

But.....its unenforcable in court, and they know it.
