1st Credit onto me for non-existant debt!!!

Received a letter today from 1st Credit chasing a hefty debt passed to them apparently by SkyCard.

 

Sky Card was satellite company Sky's credit card ran by Barclaycard. Late last year they dissolved Sky Card and transferred all customers over to Barclaycard. All outstanding debts would simply transfer across. At the time i had £0 debt with Sky Card and had not used it for 6 months. I have never used the Barclaycard since they sent it.

 

Just called Barclaycard who confirmed i have nothing on my account and didn't on Sky Card.

 

What should i do??

Report 1st Credit to the OFT - you won't be the first. you won't be the last

Thanks guys. Even though i am confident in my financial history with Sky, it still has me worried.

 

I was wondering if someone had stolen my identity/card details and racked up debt but that still doesn't make sense as Sky/Barclaycard would be chasing that debt, they wouldn't just pass it on to 1st Credit without first spending months/years getting me to pay and iv'e had nothing from them!!!

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

Just got letter purporting to be from Barclaycard saying they have handed over my debt to 1st Credit. It states all payment be made to them.

 

Address on letter is Barclaycard House, Norwich Way, Liverpool, L32 8UY.

 

Dodgy??

 

 

You will find that this so called Notice of Assignment from Barclaycard was in fact CONcocted by the very same threatomatic machine in Reigate that sent the begging letter from Worst Credit. Examine in closely. You will see a number of Barcodes and lines down the sides as well as Worst Credit reference numbers. You can bet your life that it never came from Sharklycard.

Check your credit file if it's of any importance to you, as if they have been treading all over it with their great clumsy feet, then you could be quids in, each incorrect entry that has been placed on your CRF will cost them, and the going rate is £1000 oer incorrect entry!

 

Also if you find that they have added adverse info on your CRF then you need to bring the CRA to account also.

No, they should all have the same info, if you want to do it for free then you might like to use these:Free Credit Report now and every year - annualcreditreport

 

However checking your CRF only alers DCA's that you are concerned, and may open the floodgates to their fabricated debts and imaginations.

 

I personally would check with the most popular of the three Experian first, then hit the others second.

In that case Ignore them, just report them to all of the relevant organisations, OFT, TS via consumer direct, getting into a game of letter tennis will only lead them to believe that they have got their man and you are merely a case of 'Wont' pay'.

 

Every letter they continue to send, file it and send a copy of them to the OFT and TS.
