    • Just to clear it up, sorry I don't make sense sometimes. I have paid £4000 £1200 of that was suppose to clear the £1200 debt.   Meaning I have sent a extra £2800 on top of my normal mainternance money.   Thank you

    • Hi, I shown my key worker a letter that was sent to me saying that I owe £1200, she setup a standing order around 2021, this was to pay back money I owed, with my mental health status I have had complex issues to deal with and I just simply forgot about this standing order so it has been running for about 3.5 years acording to my key worker, anyway I'm not worried about the money that was sent that I call a overpayment, it went towards supporting my child's household so I am just happy with that, I am a little sad that I am being told I still owe this £1200, I have sent bank statements over 3 years worth but they have not taken away this £1200 bill and still say I owe it   Thank you

Reputable companies join a trade association that operates a code of practice, but membership is not mandatory, and mistakes are common. Last year, a teenage boy was chased for a debt of more than £900 by debt collectors acting for the energy company Ovo. A "trace agent" had somehow linked him to the debt because his parents had previously rented the property in question. An investigation by the Observer established that the debt had been run up by a subsequent tenant. The consequences of mistaken identity can be catastrophic. Individuals who are erroneously linked to a debt face, at worst, court action, bailiffs and a ruined credit rating. At best, they can endure weeks of stress and paperwork in order to prove they are not the debtor. It is estimated that 20m identity traces are made in the UK every year, many on behalf of companies that are owed money. Personal data is often obtained from credit reference agencies, which record applications for credit, and details are supposed to be verified with several different sources before being used for debt enforcement.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

can you tell me please m8 what is best to do now, if shall i contact WF branch manager and discuss my account or wait till they send me some another letter or contact Nottingham office.

Theres one another think about mine Default Notice, if you can check that, im not sure if im right, but there is propably WRONG adress of Welcome Finance because i signed my agreement with WF Nottingham and in default notice is adress of Perth branch...

I just checked the default notice for you and to my knowledge it doesnt matter what address of their premise is as long as the company is the same (as in section 3 of 1983 regs the adresses have to be included) and it is issued to you being the same name as on agreement.

 

However this default notice contains no numerical date and only specifies a timescale which is not sufficient so not enforceable. This is specified in the 1983 regulations.

ok and what about rest of their crap m8s?

I really hate they buy my old car from me for only £1 when i been told by sales rep he give me £2000... Even any scrap yard give you minimum £80 for crap car with broken engine and my old car was in perfect condition, after service and MOT test!!! I dont realy know what to do next, i dont want pay any more for my car. I think i termminate my account but i dont if is it good think at the moment or shall i wait for next step from WF guys???

Just reading all this re yur WF car. I had an issue with them back in 2004 where I had paid enough to terminate and hand deliverd the letter - they then said they did not get the letter and defaulted me and said I was now unable to had the car back - they will do ANYTHING!!! to make money off you!!! They have no soul and dont care! make sure you do everything right, everything in writting (recorded delivery) To date even now after 6 years i have a default of £8000 on my credit report from welcome that I am still trying to get off - I made them take the car back eventually - but they still persued the money with mega intrest and charges on top - I pretty much told them to Feak off and contacted a lawyer - they decided not to go to court over it so have never persued me for the money - but refuse to take it off my credit report!

 

Anyone reading this - stay well clear of welcome!

 

And if anyone has any ideas how I can get this default off my credit report (defaulted March 2005) I live in Scotland - please feel free to offer some guidance. I am in the middle of writing a request for Consumer Credit Act 1974, to see if there is anything here I can use.

Sarah please do nothing untill we have had a chance to go into more detail.

 

You need to start yuor own thread here as you come under Scottish law your account will be statue barred after 5 years which meens you owe nothing. I do have a few questions to ask you on this first. please start your own thread and we can discuss further. BTW good advise you given there.

Cool Ozzy I will pop my thread on - never have I wanted to see a company go under as much as Welcome - I sware I will dedicate my own time to help poor people out of their crap deals and cons! If I can stop one person from getting a loan off them - it would feel lovely to know I have helped!

Hi, so i buy today another car, so now can put back wf car.

So do you think is it good idea go to WF branch handle all documents and keys of car with termination letter and finish contract???

Mattes, going to do a summary for you then from this we can work out which direction you wish to take with your account.

 

1) You received a letter on the 22nd Jan saying your hire purchase account has now been terminated and the full balance of the account is now payable, however this letter was not a legal document but a letter sent to scare you as headed "without predjudice" . . it is not a termination document....

 

2) You purchased the car in April 2008 and in December 2009 you received a default notice (the default notice did not have a numerical date so legally it will not old up) you stated you can pay 100 last week and 100 this week and your monthly payments are 253 a month. You also state you do not want to lose your car.

 

3) as per below working out the agreement does check out as being correct and justified.

 

4) You had previous agreement that started 06/04/2008 and resigned agreement on 24/04/2008 because you cancelled and claimed back PPI .

Lets look at this agreement...

 

 

amount of loan £8174 over 4 years at 19.85 % apr

 

48 monthly payments of £241.15

interest charge will be £3401.50

total amount payable will be £11575.50

 

GAP £420

 

48 monthly payments of £12.39

interest of £174.77

totally amount payable £594.77

 

so interest for car is £3401.50

so interest for insurance £ 174.77

 

total interest of £3576.27

 

so the total amount payable is

 

Loan £8174

interst £ 3401.50

Total £11575.50

 

insurance total £420

interest total £ 174.77

total £ 594.77

 

add loan £11575.50

insurance £594.77

 

total amount payable £12,170.27 add the £1 option fee gives

£12,171.27

 

divide by 48 months gives a monthly figure of £253.56 (your agreement does check out )

Too be honest Mattes im going to leave these questions for somone else more experienced as I am not that clued up on HP car loans and how each one of the above scenarios could play out.

If you are sure you want to terminate rather than them repossess on a defective default notice and drop themselves in a whole heap of trouble then i would suggest maybe writing to them and checking that the figure they require is equal to 3 payments as you may get a nasty shock and find it is more. Im happy to have a go at a letter for you in that respect if you are in a rush to get it gone if not await postggj's return and he will do a letter in respect of what he found wrong with the account. totally up to you

Yeah i know, but im waiting over one week for letter from postggj, i know he is propably busy but i scared Welcome finance come to my door this week or very soon so i want start do something m8 but i dont know what.

Your idea is quiet good, so could you write some letter for me to send to WF please?

Because as you seen i had few problems with them and my big problem is i lost £2000! for trade in my old good car because they paid me only £1!!!

And i want this money back because they know im foreign when i was in Edinburgh showroom and the sales man told me i can get the car only at day when i was in, because i told him im not sure of i really want the car from them so he never even give me half hour to go thru all documents and check them. He give me about 20 documents for sign so never had time read them properly, i know its my fault but im not happy with this m8....

Please help me!?:(

If you are wanting to claim back from them im not nearly knowledgeable enough to write the letter for you and wouldnt be happy doing it and then it causing problems with you claiming the money back. Ill see if i cant find someone that can help ;)

i no need to claim back now from them, i just want help what to do now m8 when they send me wrong default notice and letter Without prejudice last week...

I know what I would do but you have to decide what you want to do the way I see it is:

you can either:

1. terminate and no doubt end up with debt hanging over you and no car

2. wait and see what their next move is and deal with them when they make it if they repossess on the default notice they sent you its called unlawful recession of contract and you can take them to court

so they can repossess the car on default notice which they sent me on december 2009 ???

Because at tuesday i had missed call from MOBILE number with voicemail where some WF manager (never spoke with him before) told me if can i contact them on WF branch number to discuss when they can UPLIFTED car from me because i never meet payments... But i never received any repo letter from them!!! Only letter last week which is on 1st message here m8.

they 'shouldnt' repossess on that default but that doesnt mean they wont and the fact that you have received no notice of repossession i believe is again against guidance the point is if they take the car on the back of that defective default they have created a whole load of trouble for themselves should they take you to court or you take them to court. Im going to have another read of your thread now. Did the covering letter of the default notice have without prejudice on it as that again is in your favour...

 

It is my belief that if they repo on that notice you will get all money paid returned + 8% interest plus car of same value and mileage as the one they took due to unlawful recession of contract.

Default notice letter DONT have 'without prejudice'... Letter 'without prejudice' came to me this tuesday so if u want i can scan this letter and post it now for you, so you can check what is it...

In default notice letter i been told here by postggj is wrong the date in sentence: to remedy breach you must pay to us the total arrears of £ within fourteen (14) days.

I been told because its not specified there date where is 14 days so then this default notice is not valid, is it right???
