Can a lender sell a debt while it is in dispute?

Hi Everyone

I would appreciate if you can refer me to a law or document that prohibits lenders from selling a debt on while it is in dispute. I had a dispute with MBNA but they sold the debt to DCA during the complaint.

CCA s78 (6) in default of your lawful request means they cannot take further action, which includes sale.

This is incorrect the dreditor is fully entitled to pursue the debt whilst a section77-79 breach is in rogress. McGuffic

 

The practice of debt (by the debtor)sale is not possible under the legislation.

if you sell your debt the creditor will continue to pursue you as the other psrty to the agreements. The creditor is permited to reasign the debt this is another situation completely and even then unless there are specoal circumstances the debt itself only is asigned the agreement remains with the creditor.
