I have received the second letter having stated that I will file a claim if not met with a satisfactory response etc....

 

The letter says "No refund", but if you are not happy write to financial Omnibusman....you have 56 days or file will be closed"

 

I then receive third letter. "Your complaint has gone to Member Relations Manager who has 8 weeks to deal with complaint, you will have the findings of the investigation by 15th September".

 

What should I do next? Should I wait for findings or conitnue with the online claim application?

Pursue the time frame dictated by your letters.

 

If you have issued a prelim letter then 14 days later sned your lba, then another 14 days and file a claim.

 

 

If you delay they rely on that and will continue to fob you off one way or another. foolow through with your process and claim imho.

Do exactly has Glenn said, the time frames given (by you) are reasonable, you will get your money quicker if you stick to YOUR timeable. If we waited for the bank we would still be waiting for our money and we have had two settled in the past week :)

You need to calculate the interest from the very first charge you had. Are you using the CAG spreadsheet? as it calculates out the interest for you.

The wording of your moneyclaim should read something like this....

 

Claimant has account (A/C No) with Defendant from (Date a/c opened)conducted on their standard terms and conditions. Claimant is claiming the return of (£0.00 = amount claimed) taken by Defendant in charges over (X) years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e.

In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the CountyCourts Act 1984 at a rate of 8% a year from(Date of 1st charge) to (Date of filing claim) of (£0.00 =8% spreadsheet calculation) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00p = Amount claimed x 0.00022).

The daily rate will be your claim (before interest) x .00022

 

So if your claim is £1,399 your daily rate will be 31p

aww that is a very kind thing to say :) It is just really nice to give some support back to some of the new members, I had a lot of support and advice when I was first putting in my claims. This site and its long standing members make what could be a very daunting process much much easier. It really is good to see the members (some of whom have suffered terribly at the hands of the banks) get their confidence up to get their money back.
