No they are both differant credit card charges never went to court as they agreed to reduce them so yes claim them bark

Finally if you succeed with your claim please consider a donation to consumer action group as those donations keep this site alive.

Yes you should claim the charges back.

Some credit card issuers will offer you the difference of £12.00 if your charges were more.

If your charges were £12 they will try to say they are fair and was agreed.

In the OFT investigation in 2006 the £12.00 was determined as reasonable by the OFT.

However only a handful of CC issuers actually took part in the investigation.

Even in its conclusions the OFT said only a court could rule on the charges not being a penalty.

So invite your CC issuer to provide a breakdown of costs which show the charges to be a true pre estimate of their loss.

I suggest that you start a thread if you have not already done so,in the card issuers forums.

Get your claim in and dont accept any nonsens from the card company over "refunding the difference" £12 was stated by the OFT as the maximum charge and theyve all adopted this figure, that doesnt mean it costs that and they are still responsible to show you what it costs, they will cave in usually once court papers are issued

To be absolutely blunt with you, yes absolutely.

The OFT report in 2006(OFT 842) stated this:

 

 

"1.14 It must be stressed that this is a statement of our position and reflects the exercise of our discretion as an enforcement agency. Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims"
