      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Greetings Dotty,

 

As you have had no reply to the above letter which is also past the 14 days given which is more than enough time to reply I would now go ahead and do as you said.

 

Send the complaint of to the FOS, as they have already been fined you chances of this being upheld are very good.

 

The PPI consumer questionnaire [in Word format] is on the page link below:

This is the new updated form so fill this in you can do it on your pc as its in word format.

 

Enclose copies of all letters etc to and from capital 1

 

If this is a joint account you will both have to sign (I made this mistake and had the whole lot sent back)

 

Sent this off with a covering letter to the FOS contact details are on there website.

 

If Capital 1 want to play silly buggers so be it let them pay the FOS fee which I believe is now £500.

Hi Dotty, how are you getting on with your claim?

The adjudicator at FOS agreed with me in July, but still waiting for the outcome.

Have phoned every couple of weeks, and last time I was told they had put a hold on capital one paying out as they were ripping people off and not paying what was due! Apparently, management at FOS are sorting it out, and then things will get moving again, but no idea of timescale!?

Oh well, at least it will have more interest added with the delay:lol:

TBH I have done nothing!

 

Had a busy summer sorting student house out for my son, 1st year uni but no halls so it's not been easy.

 

I keep saying I will get cracking and must do soon!

 

I am not getting any grief from them either so maybe they realise they may have to pay up eventually so are out chasing others who haven't found CAG!

I'm just updating this for anyone who reads it and wonders what happened.

 

Having heard nothing since June 2010, I received a letter from Lowell Portfolio advising that they had purchased the debt, this was followed up by another letter from Cap 1 confirming sale.

 

Lowells have sent another few letters asking for payment or a payment arrangement to which I have not yet responded.

 

I always wonder if it is best to ignore (unless it's a threatening letter) so that my file stays at the bottom of the pile so to speak, rather than to keep bringing it to their attention.

 

The Cap 1 account disappeared off Noddle (CRA) but has now returned under Lowells.

 

Default date is Dec 09 and my last payment was July 09 so another few months to SB! :-)

around a year to go! if can sit on it, hopefully it stays right at the bottom :)

 

how did it return?

I didn't pursue the ppi, I think other things took over at the time but I guess I could use it as a lever, should they get nasty!

 

Fortunately this isn't a huge amount but still a concern as it's Lowells. They issued an SD on my OH last year but it was successfully set aside with some assistance.
