Until the recession I was fairly succesful and took out a car HP for over £35000 therfore unregulated with Black horse

I got behind with payments and eventually the car was repossesed with me giving them the keys log book etc with out falling out about it


They are now chasing me for a balance of £1100 after the car was sold I have asked for a statement from them months ago but they havent sent it to me but they are now getting more threatening


What is the normal legal position with balances with this type of loan and what options do the DCA have for enforcment??

LOL no not any more it was repossesed

BTW it was a BMW 6 series convertable a beautiful flying machine and an extravagance that I though I could afford but proved I couldnt

Now every man and his bank are chasing me and I had a very successful business with amazing credit ratings and profitability but the banks pulled the plug on 4 properties I built before I could sell them myself.

any guidance will be apreciated

hope I have posted this agreement up properly






I did notice that the copy of the agreement they sent to me was not signed dont know how good they are at getting signed docs back from the original vendor of the car

Now got a hearing date with BH ordered to provide the original agreement the only copy they gave me following cpr request was a copy of the faxed copy from the dealer

they are also ordered to provide the default notice and underwriting sheet and details of any commisions paid to the dealer



if they dont have the original can i fight it off also does any one know about the default regs on unregulated loans

had the same problem and had to sell the car private and pay the 4k shortfall, I was told on the site this was the only way out of it, they will just sue you for the shortfall as finance companies are not in business in selling cars , especially unregulated agreements ,and mine was december 2006 agreement
