      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hiya All!

 

Thought I would grab your attention with the title but it is basically what I am. After fulltime employment for 3 years,at the age of 21, I decided to go to University.

I have just graduated and started to get serious again about money!

 

Basically, when it comes to bank accounts I have been very ignorant and stupid.

I have had the same account with HSBC for 8 years now and the problems have only occured in the last 18 months. Previous to this I never went into my overdraft at all. I didnt want to get rid of this account so kept it for the Direct debits and my wages from my part time jobs and opened a student account with Natwest.

My overdraft was set at £200.

 

In November 2004 and December 2004 I was charged £125 on both months because I bought Xmas presents, went £350 overdrawn ie £150 over the limit. Both time my wages covered this within a couple of days but they charged me £125 for the privilege. In Feb 2005 they charged me £100 for the same reasons. HSBC see this as reasonable because they never had the money overnight.

 

In total the amount for the past 18 months in overdraft fees is £550 with the lowest months payment being £40. Do you think I have a case at all?

Hiya!

 

I am choosing to try and claim back just my total charges which are £550. Do I need to rephrase the first letter at all to say the actual phrase "total charges".

Also, should I add a personal statement at this time about how my overdraft was covered within a couple of days after going over or is it unwise to add anything personal at this stage?

 

With the original letter, do I send copies of my statements with the total charges highlighted???

The guys above are right - I was in a similar situation and my account was closed but I have jsut successfully received a full settlement offer from DG solicitors (HSBC's solicitors) for 600.27!!!

 

Get the DPA request off to them right away and keep us posted ;)

Sent my preliminary letter on 15th August, was received and signed for yesterday. I am requesting the repayment of £550 for overdraft total charges which means that on a couple of months I must have gone overdrawn 5 times to gain £125 charges for that month. I did not claim for overdraft interest.

 

Patiently waiting now!

Good luck Ced. Don't be surprised if you don't hear from HSBC til the last minute! I've sent prelim and LBA and haven't heard a word from them!!

You can see from the other threads on here that they are likely to send you fob off letters, hold your nerve and take them all the way!! :D

I have my Natwest student account as back up which has a £1600 interest free overdraft in case I win and they shut my account. I have also just opened an egg savings account as I fully intend to start being a good girl from now on!

Ok so absolutely no reply from HSBC with regards to my preliminary letter and I know they received it two weeks today.

 

I am just putting together my Letter Before Action but due to a last minute holiday, I am going to give them 28 days instead of 14 as I am leaving on the 12th Sept. I know of course they will draw it out for as long as possible, however I get back the day before the last day is up rather then having to issue court dates etc from crete.

 

Luckily I live in the same street as my parents so that in the highly unlikely event that they get back to me with an offer, they have been told to open any post from HSBC or that looks important because I don't really get anything important these days!

 

I am sure I will have some questions about the spreadsheet to follow!

Well no questions about the spreadsheet - what a wonderful spreadsheet it is! Would love whoever made it to give me a tutorial on Excel lol!

 

I modified it to my specifications ie deleted the right side of it about interest but its amazing how the 8% is worked out on the other sheet (which of course, I know not to send yet).
