    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.

    • My defence was standard no paperwork:   1.The Defendant contends that the particulars of claim are generic in nature. By reasons of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I dont understnad much about Retail Loss Prevention. I understand that shops use it to try and recover money from people who have been accused of shoplifting.

 

I would like to understand more about what happens to the people who get acused of shoplifting.

 

From what i heard on the news/radio the shops are now trying to take people for money rather then call the police. It just sounds fishy.

 

Its like they are trying to profit from crime. I dont see why the shops waste police and courts time with stuff like this they should deal with it but trying to obtain money from people its just wrong.

 

Sorry for the rant but i am so against supermarkets and big chain stores

because they came along they did small shops out of business then they dictated to the suppliers the prices that they will pay.

 

The products in store get smaller but the prices rise and then they got insurance and i believe that they gain from shoplifters because i believe they write stuff off thats damaged when in fact its not damaged and then they want to hit people acused of shop lifting for costs.

 

One firm on the high street i once worked for we arrived at work one morning and one of the members of stagg notices the broken windows and called the police they arrived did hardly anything.

 

The people who broke in stold all the expensive perfume they could carry and most of it was left behind. The manager wrote the remaining perfume off as being damaged and then she sold it off cheap to the stuff on the hush.

 

if the people who did it ever got caught i bet they would try and recover costs too.

 

I just feel its a crazy world we live in :confused:

But lets remember-the consumer chooses where they want to shop,and Supermarkets have been our choice-as long as everyone goes there then they will get more powerful both you and me have given this oppo to them.

I watched from my window as the Coppers loaded loads of spirits in the back of their Police car...which the Burglars had left after the Alarm went off.

They caught the guys but do you know what they was charged with ?

Burglary and theft of 88 quids worth of wines and spirits !

Ha Ha I bet those coppers didnt need to buy any whisky or Vodka for 12 months.

Hi,

 

I haven't heard anything about about shops making money from theft instead of calling the police. It's open for them to make a civil claim but that would be harder to argue than a criminal case if it's gone unreported.

 

If you get caught shoplifting you have a choice of pleading guilty and it will got to the magistrates or you can choose to plead not guilty and have it dealt with by the magistrates (if they agree) or a jury if you choose to.

 

I can see what you are getting at but someone has to pay for the crimes..and it's usually an increase in prices that hits all of us regardless of the insurance. For every shoplifter that is caught there are several that go undetected and it's rarely a one-off incident. They just happened to get caught on that day when they may have gotten away with it for a while previously.

 

Economies of scale have a lot to answer for but all you can do is vote with your feet and use local suppliers and local produce, but you have to suffer the higher prices.

Agreed Crapstone but we are not talking of shops making money here-in fact its been reported that RLP actually pay the SHOPS to get their feet under the table and take over their security.

Everyone pays for losses the insurance industry wouldnt want it any other way.

When we speak of loss prevention companies though we are not talking of Magistrates Courts....with a Police prosecution the store is at liberty to ask for Compensation and costs.

Here we have a scenario with RLP that denies the accused of fair trial and a demand for £147.50 with assumed rights to process their data thereafter.

 

The only likeness to the actions of Police and RLP is that both can be very predictable.

The comparison though ends there.

With the Police you know that you have rights to a fair trial should the CPS decide to take it on.

With RLP there is no such right...........they regard themselves as Judge,Jury,and executioner and masters of threatograms.

 

Just to endorse-CAG does not condone nor embrace shoplifting.

But Condones and fails to embrace RLP practices.

I remember seeing a documentry late night on fiver once about shoplifters and most of them got delt with by the police and let off with a warning.

If they did it to much they got banned from the area.

 

Not once did they get taken to court unless they got caught to many times

then the police would get a cort order to have them stopped from going in to town between the opening hours of the shops.

 

Then this whole RLP thing started. But you say with RLP you have no rights but under law no one can violate your human rights if they do it becomes criminal and personaly if i had dealings with RLP i would go after them for human rights violations.

 

But saying that i have never had dealings with them because iv never shop lifted.

I kinda had some fun with tesco's today. I believe the law says that your not stealing unles you leave the store without paying. So Today everything i wanted to buy i just put it stright in my pockets infront of the cctv

I was walking around with my pockets full.

 

Then i just went and paid for my stuff and reloaded the stuff in my pockets and off i went with the reciept.

 

Sounds silly i know i just like to annoy tesco. Iv seen people eat and drink the stuff they buy before they buy it and then just pay using the empty wrapper.

 

Makes me wonder how they can tell if your going to steal of your just pocking or eating the stuff until you pay for it or if you are going to snag it and run.

 

Not that iv ever done that.

 

I just like to tick the large guy at security off as a way of saying thanks for ripping me off

Crapstone as someone who does use local traders butchers, bakers greengrocers etc I can assure you they are often much cheaper than supermarkets. Also their produce is usually local & of better quality

 

The claim that supermarkets are cheaper than local traders is a myth perpetrated by supermarkets. Their only advantage is their free parking facility & the fact that everything is under one roof & if your willing to forgo this convenience then local is better

Any butchers etc must be better then tesco at any price. Why? because half the meat at tesco is not very user friendly meaning it is like leather. But local butchers Well rooks for one i go to and their meat rocks.

I like taking the p. The times iv been in there and well been ticked off because of certain things. Like I go to buy one product they stop stocking it.

I got to by another and they make it 100ml smaller and whack £1 on top of the price. I go to buy something and they price it up wrong or there is no price on it the list goes on.

 

Some day i might get banned from tesco but big deal. There is Sainsburys ,aldi Atleast Aldi are not greedy.

 

I dont see any basis in law for them banning someone for carrying their shopping in their pockets until they paid for it. I mean they dont ban people who eat their shopping while they walk around the store

But as you and I know-they dont need to give you a reason to ban you-they will just say dont bother coming back here again.

At a push they may say that you could be inciting others to do the same.

Theres also ASB....which lots seem to think they can manipulate to use themselves because its virtually limitless in interpretation

What one person may consider anti social behaviour,another might find its not so bad.

My point overall is that if they tried to ban you for race religion or other discrimination,then you could have them.

But if they banned you for putting shopping in your pockets and not using their baskets...then it would be very difficult getting support for that.

I think it depends where you live in the country. My own local ones, are without doubt, more expensive and living in the Mids the farming isn't exactly thriving. But I have grown my own in the past and do head out to the odd farmers market. (Not that the farmers are odd!)

 

I totally agree that the quality is far better than supermarkets

I was reading recently of food co-operatives being on the increase-it seems a good way to go.

Lots of people are turning to growing their own stuff too.Having been to Romania Russia and Ukraine and seen how people live off the land almost entirely in remote parts its amazing to see.

But its not quite so practical here.

If you had cows and chickens in your back yard you would get too much grief from next door neigbours.

If you want to fish you have to get permits and licences.

The English weather is not the worlds best for growing anything....and if you are seen near a forrest with a shotgun then the police helicopter is overhead within minutes with ARVs not far behind.

 

The common market destroyed our agriculture,dairy and fishing industries.

 

Just like the energy and fuel problems we face ....governments have done too little too late-but now finally do admit that demands for food in the future will be a major headache.

Agreed Crapstone but we are not talking of shops making money here-in fact its been reported that RLP actually pay the SHOPS to get their feet under the table and take over their security.

Everyone pays for losses the insurance industry wouldnt want it any other way.

When we speak of loss prevention companies though we are not talking of Magistrates Courts....with a Police prosecution the store is at liberty to ask for Compensation and costs.

Here we have a scenario with RLP that denies the accused of fair trial and a demand for £147.50 with assumed rights to process their data thereafter.

 

The only likeness to the actions of Police and RLP is that both can be very predictable.

The comparison though ends there.

With the Police you know that you have rights to a fair trial should the CPS decide to take it on.

With RLP there is no such right...........they regard themselves as Judge,Jury,and executioner and masters of threatograms.

 

Just to endorse-CAG does not condone nor embrace shoplifting.

But Condones and fails to embrace RLP practices.

 

Is now a good time to say I used to be a security guard for a chain of well known shops ? ;)

 

I'm not sure about paying to get their feet under the table but we were paid far more than the companies employees, for basically doing nothing other being a pair of eyes and to deter.

 

And we did have a few nuisance customers that would open packaging on goods or conceal items before they were paid for. The shop has the right to refuse service or entry as it's only an invitation to treat and not a given right that goods have to be sold.

 

I had to ban one poor old dear as he kept opening packets and he clearly had mental health problems. One of the 'regulars' was a drug addict ....and he'd try to sneak in but when you are around 6ft 9" that's not easy to do..but he did find it easy to sneak frozen legs of lamb up his sleeve! :eek::D

I was reading recently of food co-operatives being on the increase-it seems a good way to go.

Lots of people are turning to growing their own stuff too.Having been to Romania Russia and Ukraine and seen how people live off the land almost entirely in remote parts its amazing to see.

But its not quite so practical here.

If you had cows and chickens in your back yard you would get too much grief from next door neigbours.

If you want to fish you have to get permits and licences.

The English weather is not the worlds best for growing anything....and if you are seen near a forrest with a shotgun then the police helicopter is overhead within minutes with ARVs not far behind.

 

The common market destroyed our agriculture,dairy and fishing industries.

 

Just like the energy and fuel problems we face ....governments have done too little too late-but now finally do admit that demands for food in the future will be a major headache.

The eastern europeans aren't letting fishing permits get in the way of nicking off with the carp here. :sad:

 

It annoys me that massive amounts of food are thrown away, both at home and by the retailers. It is too little, too late but people are so used to the buy now pay later throwaway society we live in that the governments have done little to discourage.

I like taking the p. The times iv been in there and well been ticked off because of certain things. Like I go to buy one product they stop stocking it.

I got to by another and they make it 100ml smaller and whack £1 on top of the price. I go to buy something and they price it up wrong or there is no price on it the list goes on.

 

Some day i might get banned from tesco but big deal. There is Sainsburys ,aldi Atleast Aldi are not greedy.

 

I dont see any basis in law for them banning someone for carrying their shopping in their pockets until they paid for it. I mean they dont ban people who eat their shopping while they walk around the store

 

Why do you shop at Tesco if you think Aldi is better?
