    • deed?  you mean consent order you and her signed? concluding the case as long as you nor she break it's conditions signed upto? dx
    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

TV purchased in February 09, broke down on the 12th December (on / off button won't turn on TV)

Engineer called on 15th Dec said 'Can't fix it as it needs new parts' gave a date of Dec 22nd for repair. However now told by COMET that they can't repair TV until 29th Dec

Now according to COMET HO this is a reasonable time for us to wait :!: However my case is that the time scale and indeed the period is as defined under SOGA going to cause a significant inconvenience.

Sent Registered letter to COMET HO had a call 2 days later saying you'll have to wait. Informed them that I wasn't happy with this and that I would peruse the matter in the Count Court. Will today send final letter (Registered) to them in the hope they sort this problem ASAP.

IMHO you will most likely have to wait, why not contact your local newspaper, they may have a consumer rights adviser

Have spoken to Trading Standards and Consumer direct, who have been guiding me through the correct route. Both of whom say that I have a case under;

The seller must (a)repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer.

So that's the route I'm going down, it's definitely a significant inconvenience.

I agree with the above however the letter you have sent we arrive on either Monday or Tuesday, so will not leave much time.

Hence contacting the paper giving poor publicity to the store might work a little more quickly.

PS

have you requested a loan T.V.

Andy

Letter sent today was 2nd & final letter, first letter I received a phone call from their HO in Hull basically saying tough, you'll have to wait.

Asked for everything loan one etc. I even asked COMET HO if I can get the parts to get the TV fixed will you install them :!: No was the reply, we supply the parts

I even attempted to appeal to the woman's maternal instincts who called from HO, asked her how she would feel if her kids woke on Christmas morning to open their presents, only to realise their not too good if you don't have a TV :!:

One things for sure, having kept my cool throughout the whole process, I find their attitude stinks.

With all due respect, I would urge you against taking this to court. I don't think a judge would look kindly upon you classing not being able to watch TV as "Significant inconveniance" unless you'd gone the full 28 days most stores use for repair estimates. I mean if your washing machine was broken and you couldn't wash your clothes, or a computer you needed for work broke, I'd understand, but a TV?

Why would a TV be any less important than say a washing machine :?:

Is that a serious question?

A washing machine is required to maintain hygene and in doing so your health and well-being, becoming ill or having no clothes to wair is a massive inconveniance for obvious reasons.

A TV is required for nothing more than entertainment, it holds no value from a "required to live" standpoint. The very fact some people choose to live without TV's shows that unless someone is addicted to it, they cannot be massively inconvenianced by not having one for a short time, maybe over longer periods of time and factoring in the loss of attached appliances you could consider yourself to be inconvenianced.

Don't get me wrong, I'm not defending their wait times, I know being without a TV can be really fustrating, especialy around christmas. All I'm saying is your case would stand a much better chance if you were to wait out the "Reasonable period of time" as most shops define it (aka 28 days), then hit them with court action.

You don't need a washing machine to be hygienic :!: When I was younger my mother would be bent over the bath washing clothes by hand. A TV is entertainment, the children love to play Wii sports etc, Wii fit (especially when the weather outside isn't too kind).

Who sets this 'Reasonable period of time' :?: COMET :!: Unfortunately 'Reasonable' isn't in COMETS vocabulary. What's reasonable to one person isn't at all reasonable to another.

Hey Squigles it reads a little bit like my own “Comet LCD TV Nightmare” experience. Unfortunately you’ve probably got a fight on your hands here as Comet are absolutely useless when it comes to after sales support. Phoning them up will get you nothing but attitude and leave you frustrated. The letter did the trick for me, within three days of them signing for it the “on order” parts suddenly materialized and were fitted, it took 5 weeks though. Shame all the botched attempted repairs left the TV with a new more serious fault which Comet Head Office/The Engineer/Store I bought it from were aware of but didn’t nothing about it.

Id step back from the court route at this stage if I were you as it’s only been 9 days or so since you logged the fault, id only use the courts as a last resort if it runs into weeks/months. If you paid for it on a Credit Card it might be worth while contacting the cc company as they might be able to help if it drags on or if Comet become awkward. I would have took them to court but I had a lot going on at the time, builders in lots of decorating etc and it was just less hassle for me to replace it myself and nope I didn’t buy the new one from Comet lol.

I love a fight ;-) COMET HO in Hull need to understand, deal with people in a decent and dignified manner. Sticking your head in the sand and saying 'Not my problem' leaves your backside exposed, nothing beats kicking that backside.

I managed to corner the dept manager at the COMET store, as the manager is a by product of CS in Hull ;-)

Had to buy a new TV which will be fully refunded once our TV is fixed, so at least the kids can play with the new Wii games. :D As I have all our media on a server, they couldn't even watch films. At least the music side worked as it didn't require the TV :|

The threat of legal action is sometimes the best catalyst.

What get's my blood boiling, is having come up with a number of solutions to rectify the problem, then having some snotty nosed, faceless, unhelpful sorry excuse for a human being saying 'No' without thinking.

Squigles I forgot to ask, where did you send your letters to? Comet’s proper head office is in Rickmansworth Hertfordshire and the Hull office only deals with customer service issues (lol that made me laugh). Like I said before you’ll get nothing dealing with the Hull Monkeys, best off going directly to the organ grinder, MD’s Office in Rickmansworth.

The people at Hull that I’ve spoken to over the phone were terrible, they lied to me on a number of occasions, even telling me the sale of goods act didn’t apply to Comet lol and were generally very rude. One person even put the phone down on me because he couldn’t answer a question.

Glad you’ve got a TV for over xmas, lol I couldn’t imagine being without telly at this time of the year.

Rickmansworth :!: Nope don't have the address for that one :| If you have it would you kindly post it up.

Who knows maybe I can find someone there with an understanding of 'Customer Service'

What gets you is that you do all the solution finding, in the vain hope that you connect with someone with a heart :)

lol sorry I should have included the address, remember to address the letter to the managing directors office and send it recorded. Hopefully you should receive a phone call from a receptionist within a few days of them receiving it.
