    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No letter this end but 4 phonecalls, I think I might take their number off my reject list and have some fun with them :D

 

After all it is the season of goodwill and Im sure I could hand out the phone number for the Jobcentre to them!!!:p

Hi Sherry - can I ask is your loan secured or unsecured??

 

It is a for a secured loan BUT the house it was secured on was reposessed in 2006. They are trying to just get as much as they can now I guess.

Well, Gail from the Peterhead branch decided today might be a good time to phone me and remind me that I haven't made a payment for nearly 3 months now. At my request, they did manage to get compliance to phone me.

 

Jonathan: "If you sign the new agreement, we can get this sorted out now."

Me: "Unless you agree to repay me PPI on ALL my loans, I'm signing nothing."

J: "We won't be paying anything on loans you had mor ethan 6 years ago."

Me: "You can't hide behind the Limitations Act J. It's all in my last letter."

J: "Why do you think the Limitations Act applies to everybody except you."

Me: "It DOES apply to me. And Section 32 applies in your case."

J: "You are obliged to repay your current loan. Otherwise it will reflect badly on your credit file."

Me: "If I had a squeaky clean credit record, do you really think I'd have used Welcome for a loan? Get real."

J: "Well, we don't have to abide by the decision of an adjudicator from the FOS."

Me: "See you in court then, where I'll be countersuing for mis-sold PPI on every loan, plus compound interest at your contractual rate."

Me: "I wouldn't bank on it. I think collections will be taken over completely by Nottingham in the not too distant future. Do yourself a favour and get to the head of the queue so you're ready when the P45's hit the mat."

all this is because rbs pulled out of funding cattles now it has a legal judgement to be first in line when cattles is carved up

just a query but as they are now officially going down the pan and only collecting i assume that goes to only enforceable debts? what about the ones that arent enforceable? i know its all guesswork but any ideas?

I am a consumer just like you, please get a second opinion or investigate yourself on anything I advise as I am in no way legally trained. Everything I know has come from the Mighty CAG and fellow CAGGERS. :cool:

Maybe someone should send them the link to the RBS forum, they might need some advice if they are getting threatening letters and calls from debt collectors.

I have put the account in Dispute long time ago and put the complain to Ombudsman and i picked home phone it was the account manager from Welcome and he went on saying that i need to start paying as Charges and the interests are being added to your account plus your credit file is going to updated with no payment made .And i told him that what part of dispute you did not get it he went on the dispute is with the Company who sold you the loan and insurance not us we are the lender so we can demand you money and can put default your account and credit history .I said to him i followed legal procedure and put the account in dispute while Ombudsman investigating into this matter so if you did not like my way of putting my account in Dispute and you want add charges and Interests than please confirm it in writing ,He said he will ask their complaint department to do that and send me letter .And then he asked me to send him the letter from Ombudsman that came to me that my case will be looked by adjudicator .I was telling him that you must call me and threat me about my credit rating he went saying it is fact not threat and hang up on me .I was so :-x:-x:-x:-x So guys can he really affect my credit file and add extra interest while the account is in Dispute ? It is a HILARIOUS OLD WORLD! I`m setting a licenced company now. To look after those poor unfortunates who have lost their jobs at Welscum Finance.

 

I will supply soup kitchens along with care and understanding of their situation. When they lose their houses, they can move in with me and mrs1arby. They will have a nice warm house full bellies and a roof over their heads. I do feel sorry for them( just like they did for me and mine).

 

NO! NO! NO! I was just in my own version of A Christmas Carol. what a nightmare. LMFAO:rolleyes:
