      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just been up to my brothers and he needs a driver for for the ethernet cable.

 

Computer worked fine before he had some problems, So I put in a new XP disc and booted it from the CD drive.

 

The yellow ? are against Ethernet Controller, PCI Devices, PCI simple communications control, Bus Controller, Video Controller,

 

 

 

There are loads of different ones that i seem to find when searching.

 

Can anyone find me a link to download one to a usb stick, which I can then download to his desktop PC.

 

It has windows XP

 

 

Totally unsure which one or what one to download

download something like everest home to your penstick

then run it

and go up on the net and download the driver from the details of the info from everest on those you have a ? by in dev man.

 

you might find it easier to uninstall each device once you have the drivers on the stick

then detect new hardware and point tothe USB stick where you have it saved.

 

you might also find it easier to get the network card working, stick on microsoft security essentials on the pc [as i would not connect a pc to the internet without any anti virus/malware protection]

 

then once you have those two going.

 

find all the ? then update the driver and allow it to search for the right one from the internet.

For your network card (the thing that is showing up as Ethernet controller), you'll need the drivers offered by either the computer manufacturer if it's a single bought unit (say, a Dell), or your motherboard manufacturer if it's a self build or you don't know who built the machine.

 

Motherboard manufacturers offer these drivers for free on their respective websites. If you follow dx100uk's advice and grab something like Everest Home, you can learn the motherboard make and model number. Punch that into Google, followed by 'drivers' and you should find a link to the manufacturer's website.

 

What you're looking to download are the XP drivers for your model of motherboard. They'll either be labelled 'LAN Controller' or 'Ethernet Controller'.

 

The same goes for the other devices you mention; they're all motherboard controlled.

 

What I'd be more concerned about is what happened to cause this. It looks as though your brother's mothboard lost a great deal of it's core drivers, or they became corrupted. You mention the "Computer worked fine before he had some problems". What were the problems? Because if unless those have been fixed or you're sure they're not going to reoccur, we don't want to patch it back together only to have the same problem happen again.

i would suspect an hdd crash, as its lost lots of drivers and obv OS files too.

hence the CD boot needed.

Before I done the above, ( I done the above as I thought that would cure problem, as we could not even access safe mode to do a system restore)

 

It was something along the lines of MSGINA.DLL.XXXX

Contact system adminstrator

 

 

I looked this up and still tried the options offered to no success.

 

That is why I rebooted

launch everest

find the network tab on the left

or the network icom on the screen

 

click that a few times and it will tell you the network card that is in your pc.

 

then either let us know here

or paste it to a search engine with winxp driver for XXXXXXX

 

get the idea?

Is this what I should have.

 

Used Everest and got devices, I found the ones with the yellow ? beside them.

 

it returned 7 items

i'd get the ethernet device working then let xp do the work of finding the other drivers via update and allow it to search online.

i have that mainboard and i also have the install cd foxconn support will have all the drivers to download

They are probably newer drivers than the ones you are running now. If the hardware it points to is running OK, I'd leave it on its current driver.

Guys, you have done superb, i have it up and running.

 

the other yellow? i just asked it to reinstall the drivers.

 

only 2 failed.

 

but all seems to be working well, my brother will be pleased :-D

 

PCI Device and SM Bus Controller the only 2, Don't even know what they do :confused:

A PCI device is any device plugged into a PCI socket. All motherboards have a number of these sockets, into which you can plug dedicated cards, such as sound cards, network cards, etc.

This is appearing either because you have a device plugged into a PCI socket and Windows doesn't recognise it, or, less likely, Windows is having a problem recognising the PCI socket itself. Do you know if you have any cards plugged into PCI sockets?

 

The SM Bus Controller stands for System Management Bus Controller, and is an integral part of some Intel chipsets. Intel have a fix available for this issue, which reinstalls elements of your chipset so Windows recognises it properly again. The solution is available here: Intel® Chipset Software Installation Utility - Intel® Chipset Software Installation Utility support
