Hi, my first post but hopefully someone with more knowledge on these things can help.

Brief breakdown - took a loan with HFC in 2000 for £6000, no payments missed, etc. until September this year - contacted them and asked for a settlement figure and was told it would be just over £4,400. Requested details on full ammounts that I had paid, rates, etc. as by my reckoning I had made approx.£18000 in repayments. Nothing came of it, After numerous attempts to get this info and being repeatedly told they would be sent, I followed the advice on the forum and sent them both a Subject Access and CCA (sent seperately recorded delivery). Received response to the Subject access request stating they would not send details unless I sent a photocopy of my passport or driving license. I then received a letter re: the CCA with a blank loan application form - both attached. The loan agreement is totally blank with no details and the letter states that there are exclusions which allow them to respond to the request in this way and not provide an actual copy of the original agreement - as per attached , the agreement is totally blank - no details of rates etc.

Any help or advice would be very much appreciated

Welcome to the site.

You need to fully remove the reference number in the first attatchment,together with the date since this easily allows HFC (who are known to be monitoring these forums) to work out your identity.

I would also remove the date that appears on the letter since they could reconcile that also,especially given that all the figures are included .

As a precaution I have removed the attatchment.

i know hfc take this ** but you've paid £18k and still over £5k

and i bet you're paying PPI too.

 

how long was this loan for?

almost 10yrs down the line you're still paying it?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi DX - this was a major oversight - actually thought the monthly payment was for something else - re: terms of loan - genuinely don't know - it was called a personal plus loan but cannot get any details from HFC on terms, rates etc. hence the subject access and CCA being sent. I did not think they could just send a blank agreement as a response.

can you confirm it was for £6k in 2000 and over how many months? and what was the repayment

Hi DX, all I know for sure is that early 2000 ammount owed was 6000, payments since have varied - originally about 175 pm now 161 pm.

Sorry should have added - is there a template for a letter when they send back an unsatifactory reply to the CCA letter?

Yes there are letters for non compliance in the library which you can access via the home page.

You may feel the need to modify/add more there,which address some of the specific points you are raising here.
