Do Unpaid Defaults 'fall Off'???

Hi,

 

Can anyone help?

 

I am in dispute of 3 defaults showing on my account, and have not paid since 2004.

Will these debts 'fall off' after the 6 years is up, or not?

 

Trying to get a mortgage, but have been advised by the mortgage advisor that these debts will still be on my file as they are unpaid.

 

Any help would be GREATLY appreciated!

Yes 6 years from the date of default, whether or not you have settled the account.

Just wondering if you've checked your credit file recently as it's not uncommon for DCA's to add defaults also.

 

I would just make sure that, when the time comes, you check your file to ensure that the defaults have been removed and, if not, write to the CRA concerned insisting upon their removal.

Is it really 6yrs from default or 6yrs since default or what they call "acknowledgement" e.g. payment

 

Situation I'm thinking of is :-

1. get into difficulties

2. default/termination issued

3. agree minimal repayments

4. discover CAG and realise they haven't got an agreement

5. stop payments

6. receive endless threatograms.

 

Where does the 6yrs start?

6 Years from the date of the Default registered on your Credit File, when you mention 'acknowledgement' this relates to the Statute of Limitations when a debt becomes Statute Barred from the last date of acknowledgement.

I had a default on my Equifax file with a default date of 9/12/2003. On 10/12/2009 it was still on my file. So I sent an online query to Equifax and they removed it yesterday (16/12/2009).

 

So its best to check your file after the 6 year period is up. Don't assume it will be removed exactly 6 years after the default date (especially not with Equifax). The CRA may take a week or two before they actually remove it. The Data Protection Act gives them 28 days I believe.
