      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just would like to say thank you to the site for providing lots of information to help me start the process of recieving my bank charges from Abbey.

As i have noticed I have also started to move my current account as I expect abbey to close that account.

 

I started on the 2nd Aug and they so far have sent me statements covering nearly two years and a letter stating that they will use my £10 to recoever the "mirofiche" details.

 

Anyone who has a history with abbey and could help please feel free to messege me.

As it has been a long time in waiting for Abbey I would like to fill you in on the details so far.

As with all Abbey customers I have not had my full 6yrs worth of account information so letter sent to complain about this and request the information before I report them. on Friday 22nd I recieved a letter to say sorry and if I will send them £10 they will send the missing information. ( I have already sent them a chq for £10 and they have cleared this a month ago)

My reply to this letter from Marc Winter will explain the above and they have had sufficent time.)

 

While the above has been going on I have completed the charge amount for the statements I have and produced an estimate to complete 6 years and this prem letter was sent 15th Aug. 14 days until LBA.

 

During this time I have change my account over to another bank and recieved a letter demanding money for the overdraft which was remaining in the Abbey before they send me to court to reclaim this. I have just paid up the overdraft and now have a £0 balance in there.

I have had no other contact from the abbey since.

hi lorna, i have just had all my statements form abbey so they must be getting better at sending them out. alreday closed my account with them so no worries for me there :p also im sending off my prelim on monday so will be about 2 weeks behind you in court

I've now had I'm sorry and heres £270 as good will gesture. still no statemets just another request for £10 to produce them, They have allready had this.

So LBA sent with 18 months charges and estimate of the rest.

Please would like some help, I was going to claim using an estimated amount from 19 month statements I have recieved, however I am now unsure to wait a few more weeks for the full 6 years because of the recent information regards abbey Micofiche.

Recieved letter dated 11 oct to confirm that the information has been requested and that they should arrive in 6 weeks?

(Orginal request 4th August.)

 

Please advice are abbey now getting the information to us?

I would like to inform you on my progress so far, After money claim confirmed action and recieved a statement of defence from Abbey this morning. Moneyclaim is sending the information to the local court.

 

As luck would have it I now have the full 6 years account information as Abbey have finally sent them. The orginal figure was an estimate so I need to amend the amounts and send the new figures to abbey and court.

 

Although I have read loads of threads I am now getting a little nervous on what will happen next, Any one else been there and done it to offer a little more encourgement?

What you are doing is fine. Don't worry about it. They will now play around a little bit with you but you will get what is yours in the end. Yes just make sure you keep all that they send you incase it does go to court. Good Luck.

Hi Lorna,

 

Have a look round the templates library, I'm sure there's stuff posted there for what's required in a court bundle. I haven't actually got that far yet (will be sending my LBA next monday!) so can't give you any info.

This morning I have recieved my letter from my local court confirming the move, Abbey defence and AQ. I have until 19th November to return and as my claim is under £1500 I have no more costs at moment.

 

After reading threads last night I have started to put jonni2bad list and basic court bundle on my hard drive so I guess I've got lots of reading to do this weekend.

 

I have also sent abbey a letter confirming the total amount I am claiming. (now I have the full 6 year history). In the letter I made a statement that if they wish to try to resolve this matter before a court date is set then I would be happy to review any offers they have in writting.

Not had any comuuication from Abbey. Sending AQ out tomorrow recorded and it's just sit and wait. Been a little busy with kids being ill so not done much on court bundle.

Any one know how long it takes for a court date at Chesterfield, Will this be now after xmas?

I have finally had a court date through. Monday 26th March 2.00pm estimated time of 1hr.

 

I am a little concerned as this is longer than some of the threads posted. I have also been asked to send in the schedule, statements, evidence and loads other stuff within 28days and then the abbey has 28 days to reply.

This seems different to everyone else who has posted.

 

I'm not sure if i'm lucky or not as I have not had any telephone calls of demands or threating account closer from the abbey throughout me asking for the information.

Not heard from anyone for weeks and then Wednesday recieved letter from abbey stating that as my claim is low (Total £851.28) and it would cost to much to defend they will pay out however this is no admission of legal liability and it is a full and final offer.

They paid a cheque into my account and I have transfered this out today.

 

I am now going to book my holiday for this year.
