    • Yep, those 'requirements' not met to shareholders satisfaction seem to me to be: 1. Not being allowed to increase customer bills by 40% (of which well over 50% of the new total would NOT be investment) 2. 1 plus regulators not agreeing to letting them do 'things in their own time (ie carry on regardless)
    • As already mentioned freely available "credit scores" are fairly useless. All lenders have their own "credit scoring" system, that for obvious reasons they don't divulge. And they're "scored" differently to the freely available ones. As soon as they could, we've always encouraged our two children to use credit cards responsibly... Pay off in full, etc, to generate good history. It's paid off. At quite young ages, they have both obtained loans for cars, mortgage and their credit card limits are through the roof. Personally, I have shifted debt around a lot on credit cards (even financed a house purchase once at 0% 😉) and I've only ever been refused a credit card once, sorry twice by the same company, over many years. They must have something very different in their lending criteria. You're a tight one, Mr Branson.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys,

 

I am having debt problems and have buried my head in the sand for some time. I now have a child on the way and would like to settle down and start sorting out my finances and debts.

 

I have at least 3 debt collection letters a week and its starting to get me down. Would love to start sorting it all out and paying these guys back. I want to be a good father and give my child a good life.

 

Right!

 

I have debt collection letters from 2 credit cards, an unpaid phone bill, couple of bank overdrafts and loans and a couple of gas/electric bills that have been unpaid.

 

I know its my fault and I am stupid for letting it go on for so long. I guess I was just hoping they would go away (Which of course they wont.)

 

A few of the debts are a few years old and some are more recent. I keep getting letters threatening legal action and door step collectors but nothing has ever come of anything.

 

How do I start trying to sort this out?

 

Do I have to send CCAs or something to these companies.

 

Please help me!

OK the TWO most important debts you have are the Utility bills, who is your gas & leccy with??

They are old ones to be honest so dont use them providers no more as we have moved and have a gas and electric meter.

 

They found my new address somehow!

 

EDF and another one which im not sure of. Will check when I get in.

OK, In a bit of a rush, but will need to check later if the 12month limitation applies to your circumstances or not, has there been a 12 month gap/period where they have not been asking you to pay this amount at all?

And is it still the utility companies asking for payment or have they farmed them out to a debt collector??

 

Don't worry about anyone knocking on your door to take money off you, they have "NO" legal right to anything not even a welcoming 'Hello'

Print this off and keep it by the door, and read the advice given.

Both utility bills have been passed onto debt collectors. I have moved twice since one of the bills so probably over a year old. The other one is from my last address so left there about 7 or 8 months ago.

 

I have never recieved any default notices or termination notices for anything. They have all just passed the debts onto debt collectors.

 

This is roughly what I have. Will post more details when i get in

 

Black horse (passed onto debt collector) 3 years old.

 

Halifax credit card (Passed onto debt collector) 2 years old

 

Barclays bank (Passed onto debt collector) 2 years old

 

02 phone bill (passed on) 1 year old.

 

Capital one (Passed on) 1 year old

 

Littlewoods (Passed on) 1 year old

 

They are not massive amounts to be honest. All under £1000 each. Some for a couple of hundred. Just want them sorted out.

Just before I pop out and go the gym (cleaning:D)

The Loan and credit cards (CC) if they are pre 2007 send them a CCA request (consumer credit agreement)

For the Loan it is s77, and for the CC's it is s78, just edit to suit, are they both with the same bank?

Are you still banking with them?

 

Bank Overdrafts are slightly different as they come under a different section of the CCA.

 

Do you still have a landline with the same provider that you have a debt with?

Have you been getting correspondence from S C Gray??

 

Ok, most importantly is to NEVER EVER EVER EVER SPEAK TO THEM OVER THE PHONE! EVER""

 

Keep everything in writing, and this will be your paper trail of evidence should you require it.

All correspondence you send them, must be sent via recorded delivery, again this will be your paper trail of evidence.

 

Any contact you now have with any of them regarding outstanding 'alleged' debts you must keep a record of and a diary of events.

 

So don't speak to them over the phone, they will only grunt at you, keep everything in writing, PRINT YOUR NAME never sign your letters.

And everything recorded delivery.

Cleaning??! Thought you were going for a good old workout. Cleaning is probably more of a workout than I would do at the gym!

 

Thanks for your help. I dont bank with the same bank anymore. Will send a CCA off to the credit card and loan companies.

 

What should I do about the utility bills and mobile phone bills? Write to the debt collector?
