NCP Parking Ticket

Hi,

My girlfriend recieved a ticket from NCP car park attendant yesterday for parking in a NCP train station car park for longer than 4 hours. She parked there at 6 in the morning expecting to find a pay and display machine, but could not find one, and as it turned out it was a free car park. It was very dark, and she could not see any restrictions on the signs dotted around. Obviously when she returned to her car, she had a ticket on with the standard PCC gubbins.

After looking at the sign again, she saw in small writing, that you are only allowed to park there for 4 hours free.

I know we are to ignore this, and after reading many forums, its obvious its a [problem], but can we just have some reassurance that we are doing the right thing.

Obviously my girlfriend is very upset, and is one of lifes worriers, so it would help me if someone else apart from me told her that everything will be ok.

She feels like she might be the unlucky one who does get taken to court.

Any help would be appreciated.

You need to be careful on Railway Property that you have not been cauight under Railway Bylaws - anything under a Railway Bylaw would be issued in a similar way to a proper PCN and be dealt with by Magistrates etc. It will be clear on the rear if you need to appeal via NCP or the Courts.

 

NCP are quite well known for quoting Railway Bylaws but issuing standard PPC Invoices which you can ignore.

As you know their claim can only be limited to their actual loss - as this was a Free Car Park there was no Loss on their part. Your girlfriend may have stopped another user from making use of the space she was using but how much would that other use have paid - Zilch, nothing, zero.

Is she the RK of the the vehicle ?

 

If so she will no doubt receive the stndard PPC's correspondence which will consirt of a letter or two from them followed by a letter or two from a so called Debt Collector (probably Roxburgh) suggesting all manner of nasty things will happen and finaly maybe two letters from a solictor (aka M Sobell - Ha Ha) pleading for you to pay. All strung out over a few months but it will blow over.

 

You read the fourms - the advice given is not based on "well just don't pay it will go away" bur rather "Ignore and don't pay becase what they are claiming in their correspondence does not relate to the law of the land".

railway bylaws will not apply to a NCP car park unless access or safety of passengers are an issue non have succeeded in using this ploy to make you pay.

 

its a [problem] ignore it.

Never seen a legitimate NCP byelaw tickets. In fact the only legit byelaw penalties I've seen are given out by the rail companies.
