Evening all.Today we got a visit from an equita bailiff regarding £127.67 outstanding council tax.My girlfriend was not in so a letter was posted through the door which said bailiff removal,payment due in 24 hours.Also a form 7/walking possesion was left and signed by the bailff with my partners car on it.Any advice on what i should do please as i feel im being ripped of as they have added £186 charges on top totalling to a combined fee of £313.67.I do work but am on the min wage and as such i get full house and council tax benefit as it is such a small amount of money i recieve each week.Any help would be great as its christmas and having 3 kids money is tight as it is.I can pay the outstanding council tax and a bailiff fee but surely it cant be £186 :(

hi there. you re not alone! have a look at the sticky on council tax and bailiffs. there's also another one in the thread above this one re ct. i'm no expert but having trouble like u with same company. you shouldnt let them in at all, and pay the council not them. however, check the advice on the ct thread. take care.

Write back immediately to Equita and advise that that a bailiff from their company has visited you and levied upon a vehicle and in doing so he has applied not only a levy fee but an "enforcement fee" as well and that you have sought advise and it would appear that the statutory regualtions do not provide for any such fee and in fact this charge would appear to be an "aytending to remove" fee which cannot be applied UNLESS a bailiff has previously levied upon goods.

 

You should also advise them that unless the fee is removed immediately that you will be bringing the matter of this fee to the attention of the Chief Executive of the local authority.
