Hello all.

 

I have today received a Notice of Hearing from Melton Mowbray County Court telling me I have a hearing date of 22nd Feb 10. It doesn't give me any other info except to say it's a provisional date and could possibly be at a different court.

 

This claim is one that I set in motion as I had no other choice. I opted for Mediation to try and help the situation, but defendant wouldn't come to any kind of settlement.

 

I have the floowing questions:

 

Do I need to file documents and written statement to the Court?

Can I request that the claim is heard at a Court near me as I will have a baby less than a month old?

When am I told if I need to pay a fee for the hearing?

Can I request to see all of the Defendants documents before going to Court?

If you wish to rely on any documents then you must file them with the Court and serve to the defendant at least 7 days prior to the hearing.

 

Can I request that the claim is heard at a Court near me as I will have a baby less than a month old?

If the defendant is also a Litigant in Person then they have the same rights as you to ask for the hearing to be in a Court near them.

If not, then write to the Court requesting a transfer

 

 

When am I told if I need to pay a fee for the hearing?

The Court will make a request for any fees that are due.

 

Can I request to see all of the Defendants documents before going to Court?

The defendant is obliged to file and serve their defence prior to the hearing, so you should receive a copy from them.
