    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I have a defaulted payday loan with Uncle Buck which is the last in a long line i am trying to sort out. I emailed them saying it is not an option to roll the loan over which i have previously been advised and i need to set up a standing order of £25 per month to settle the account. All i keep getting back is no payment plan can be set up and if i dont pay £45 in the next 3 days they will pass the debt to meritforce to collect the account which will include a visit to my home or work address. Having read previous threads i know that Meritforce are part of Mackenzie Hall, whom i have dealt with previously (another story completly, numpties :roll:) Anyway I just don't know what to do as I do want to pay the debt off but can't afford to pay anything until the end of the month but by this time it will be passed to Meritforce and i'm really scared someone will turn up at my work, if this happens I iwll be in so much trouble and also if they turn up my house it will send my mum into turmoil, she suffers with epilepsy and suffered a breakdown a few years back and really does not need people like this turning up and making threats. I just don't know what to do in regards to making payments? Will Meritforce accept payments or will it be another case of constant bombarding with threatening calls and letters saying they can't accept payment plans and want the whole balance. I just can't afford to pay out £300 all in one go. I know this is my fault but I really want to sort it out just want to know the best way to go about doing so in this situation. Any help is apprieciated. Thanks in advance x

Stick to your guns. Meritforce are just their DCA of choice and have been known to send account straight back to Uncle Buck when they realise you can't pay the monthly figures that Uncle Buck have requested.

 

Whichever way highly unlikely they will appear at your door as this is a common threat and you don't have to answer or let them in.

 

If you need some more reassurance PM me and I will give you some specifics on my dealings with them (I don't want them to recognise me on here). I don't have their bank details for a standing order but I imagine other caggers probably do.

uncle buck..never heard of them thought it was a movie with john candy!

 

unless they have court orders they cannot enter your house and reposses anything -deal in writing only-refuse to take phone calls and change your bank acct details so your salary can be paid to a acct that will not be debited -then u can work out what you can afford and offer it to them -they want there money and in the end they will have no choice but to accept what you offer them.

 

i have found that wonga.com and quick quid have been the best i have used i have a mate in the industry that has said a new company called speed-e-loans.com will be launching in 2010 and they are aiming to be better than these 2 major players ...keep ure eyes peeled chaps.

Just a quick update. I still have had no joy with arranging monthly payments but i haven't heard anything from meritforce and its been over 3 weeks now :rolleyes: anyway today i checked on my internet banking just to work out how much i would have left out of my wages tomorrow for christmas shopping and i discover that they had set a direct up under the name PLANDEAL LTD obviously i cancelled this straightaway! Just wondering if they can do this because i find this ridiculous they have set this up without me knowing and im quite angry to be honest that i have offered reasonable payments and this is happening. I know people will say set up a new bank account but i am just developing a good reputation with my bank :-x

I was annoyed that I had to set up a new account for the same reason, Soo - BUT, if you just set up a new account with your existing bank, the relationship will continue. It's better for the relationship in fact, because they WILL keep setting up new DD's, and eventually you will end up bouncing some. Seriously, you won't regret it as I learned from painful experience. ;)

 

Actually, I eventually ended up setting up a current account with my local credit union (I KNOW I keep banging on about this, lol) and it was the best move I ever made. I actually know the staff (all 2 of 'em!) by name, and if I ever have a problem with anything they bend over backwards to help. If there ever is insufficient funds to cover something, the charge is a fiver instead of £30 - far less likely to send you into a spiral you can't get out of. Just sayin'. :D

Report PLANDEAL LTD to Trading Standards, that is very illegal of them indeed.

 

You also need to remember that if they send somebody round at work that is a gross infringement of the OFT Guidelines on debt collection and you can report them directly to the Financial Services Ombudsman and the OFT for that little act - in fact I would report PLANDEAL LTD to them as well.

 

Don't forget to instruct your bank in writing that PLANDEAL LTD have no authority to withdraw any money whatsoever from your account.

 

Go to the police as well and report them. If you get fobbed off with 'its a civil matter' get the name of the officer/person you report to and report them to the Chief constable of your area.

 

They should not be allowed to do things like this but unfortunately they believe that your money is now theirs by right...

So now the direct debit is cancelled it should not come oput is that correct? I went into my bank at lunch and told them these people are not authorised to take anything! i am just so angry as i do want to pay this back but in monthly installments because i cannot afford all in one go but they dont seem to understand this i am getting really stressed out by this and worried everytime the phone goes at work, i sent them the telephone harrasment letter and the calls seemed to have stopped thank god! i just want to be able to pay this back at a rate i can afford! I have reported them to trading standards :)

I have responded to your pm. Typical UB only willing to accept 3 month plan. They can only have what you can comfortably afford. Nothing they can do about it.

I have heard nothing back from them about this. I have emailed them but no reply! I am getting quite frustrated because I just want them to reply accepting my £20 per month because I know that everyday they are adding more interest on :mad:
