    • @dx100uk @ anyone else interested in Fighting HSBC UK  Staff/department non compliance and incompetence/interference in between HSBC UK and customers.   I wanted to know what you guys had to say about the reply i got from HSBC UK today.    Recap. I originally turned to HSBC UK to be reunited with Money i saved in accounts that where frozen and made dormant during the year 1995.   HSBC UK Teams tell me that HSBC UK only allows them to have access to account records dated back 6 years. there for they do not have the records, can not locate the records i requested for in my SAR. there for HSBC UK teams Ignored my SAR application for records of accounts made frozen and dormant during the year 1995. HSBC then claim if the accounts where closed they will no longer hold records of these accounts and tell that to the ICO. I again explained to HSBC UK and the ICO the records of accounts where left frozen and dormant.   HSBC UK teams continue to tell me over the phone that The records i requested for in my SAR, will not be located or do not exist because HSBC only allows them to have access to records of accounts dated back 6 years.    I returned to HSBC highlighting there is no such provision in the Data Protection Act.   HSBC UK teams today totally ignored my complaint again and confirmed with me they are classing my complaint as wanting to locate accounts that where closed.   Let me know what you think about the  HSBC UK teams response to my last complaint. Is there any other letters i can send them to confirm thay are not correct about what they have done.    The HSBC UK letter starts of by:You've been unable to recover funds you held in HSBC UK Accounts that were closed in 1994 to 1995, and to obtain the account details for the accounts concerned. You've been advised that we only retain records for up to 6 years, but you've been unable to locate any provision for this within the Data Protection Act (DPA). You require a Certificate of Destruction from HSBC UK to evidence the destruction of the data concerned. You feel your Subject Access Request (SAR) has been ignored by HSBC UK.   HSBC UK Teams now go on to explain: In respect of you being advised we only retain records for up to 6 years, but having been unable to locate any  provision for this within the Data Protection Act (DPA), I can confirm that under the DPA, we are obliged to only keep records for as long as we deem necessary, in order to effectively manage our data. So, for most cases, this will be for no more than 6 years.   In regards to your request for a Certificate of Destruction from HSBC UK to evidence the destruction of the data concerned, I regret that this isn't something that we can provide, as we don't keep records of when individual customer data was destroyed. I'd also like to clarify that if the accounts concerned were closed after becoming dormant, that we would have sent you closing statements at the time.   Lastly, I'm sorry you feel we've ignored your SAR. I want to assure you that we'll always look to accommodate a request for a SAR as best as we can. However, if we're unable to locate the account details and information required, this will mean we're unable to fulfil the request, which has unfortunately been the case on this occasion.   How else do you think i can highlight to HSBC that the teams dealing with My complaint, and request to be reunited with my money is not going to departments that can deal with my demand for services.?
    • Hi   I have to agree if you have paid off the debt owed to them via this meter and are up to date on your bills  I would look at changing supplier and as said asking new supplier to install a standard meter and look for the best deals for you.
    • I have severe anxiety and going to leave my job and have been invited to a meeting but dont wish to attend that is three hours away from where I am. Can I legally give the  permission to decide without my being there? I cannot handle going as I know I'm going to be fired anyway as on my final warning. I'm also giving in my notice this week too! This job is just too much for me now and I cannot work here any longer. It's no good for my health and sanity  I am sick to my stomach thinking about going and about to hand my notice in anyway
    • Thankyou it’s because I’m awaiting the outcome and a friend said I will be turned down as I asked them a while back if I had ppi on the account and how much it was and they replied.  But they did only send me a short confirmation with the amount and that they trust that answers my enquiry. i just wanted to be prepared if they wouldn’t turn me down based on that. Thanks for your advice on that mate

Hi,

I have a defaulted payday loan with Uncle Buck which is the last in a long line i am trying to sort out. I emailed them saying it is not an option to roll the loan over which i have previously been advised and i need to set up a standing order of £25 per month to settle the account. All i keep getting back is no payment plan can be set up and if i dont pay £45 in the next 3 days they will pass the debt to meritforce to collect the account which will include a visit to my home or work address. Having read previous threads i know that Meritforce are part of Mackenzie Hall, whom i have dealt with previously (another story completly, numpties ) Anyway I just don't know what to do as I do want to pay the debt off but can't afford to pay anything until the end of the month but by this time it will be passed to Meritforce and i'm really scared someone will turn up at my work, if this happens I iwll be in so much trouble and also if they turn up my house it will send my mum into turmoil, she suffers with epilepsy and suffered a breakdown a few years back and really does not need people like this turning up and making threats. I just don't know what to do in regards to making payments? Will Meritforce accept payments or will it be another case of constant bombarding with threatening calls and letters saying they can't accept payment plans and want the whole balance. I just can't afford to pay out £300 all in one go. I know this is my fault but I really want to sort it out just want to know the best way to go about doing so in this situation. Any help is apprieciated. Thanks in advance x

Hi Suepoo

Stick to your guns. Meritforce are just their DCA of choice and have been known to send account straight back to Uncle Buck when they realise you can't pay the monthly figures that Uncle Buck have requested.

Whichever way highly unlikely they will appear at your door as this is a common threat and you don't have to answer or let them in.

If you need some more reassurance PM me and I will give you some specifics on my dealings with them (I don't want them to recognise me on here). I don't have their bank details for a standing order but I imagine other caggers probably do.

Good luck

uncle buck..never heard of them thought it was a movie with john candy!

unless they have court orders they cannot enter your house and reposses anything -deal in writing only-refuse to take phone calls and change your bank acct details so your salary can be paid to a acct that will not be debited -then u can work out what you can afford and offer it to them -they want there money and in the end they will have no choice but to accept what you offer them.

i have found that wonga.com and quick quid have been the best i have used i have a mate in the industry that has said a new company called speed-e-loans.com will be launching in 2010 and they are aiming to be better than these 2 major players ...keep ure eyes peeled chaps.

Hi,

Just a quick update. I still have had no joy with arranging monthly payments but i haven't heard anything from meritforce and its been over 3 weeks now  anyway today i checked on my internet banking just to work out how much i would have left out of my wages tomorrow for christmas shopping and i discover that they had set a direct up under the name PLANDEAL LTD obviously i cancelled this straightaway! Just wondering if they can do this because i find this ridiculous they have set this up without me knowing and im quite angry to be honest that i have offered reasonable payments and this is happening. I know people will say set up a new bank account but i am just developing a good reputation with my bank :-x

I was annoyed that I had to set up a new account for the same reason, Soo - BUT, if you just set up a new account with your existing bank, the relationship will continue. It's better for the relationship in fact, because they WILL keep setting up new DD's, and eventually you will end up bouncing some. Seriously, you won't regret it as I learned from painful experience. ;)

Actually, I eventually ended up setting up a current account with my local credit union (I KNOW I keep banging on about this, lol) and it was the best move I ever made. I actually know the staff (all 2 of 'em!) by name, and if I ever have a problem with anything they bend over backwards to help. If there ever is insufficient funds to cover something, the charge is a fiver instead of £30 - far less likely to send you into a spiral you can't get out of. Just sayin'. :D

Report PLANDEAL LTD to Trading Standards, that is very illegal of them indeed.

You also need to remember that if they send somebody round at work that is a gross infringement of the OFT Guidelines on debt collection and you can report them directly to the Financial Services Ombudsman and the OFT for that little act - in fact I would report PLANDEAL LTD to them as well.

Don't forget to instruct your bank in writing that PLANDEAL LTD have no authority to withdraw any money whatsoever from your account.

Go to the police as well and report them. If you get fobbed off with 'its a civil matter' get the name of the officer/person you report to and report them to the Chief constable of your area.

They should not be allowed to do things like this but unfortunately they believe that your money is now theirs by right...

Hi Soo - unfortunately you will need to keep checking your account as they may try again. The only other option is to follow ms wwax advice and set up new account.

Hi Robjam

I have a very similar situation brewing with UB - can I PM you for some advice?

I have responded to your pm. Typical UB only willing to accept 3 month plan. They can only have what you can comfortably afford. Nothing they can do about it.

I have heard nothing back from them about this. I have emailed them but no reply! I am getting quite frustrated because I just want them to reply accepting my £20 per month because I know that everyday they are adding more interest on

Sue - just because they add it on does not mean you have to pay it ;) If you want to pay them just pay in to their bank and stop when you have paid the original loan back - very unlikely they will persue you further.
