    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.
    • This other entity doesn't know what's going on.  To be clear I had huge equity.  No-one would ever expect a lender to erode all my equity.  The question is - if anyone knows the legal answer - on the basis they have a charging order - could they make an application for an order for sale?  
    • Is this place near to you? I ask for two reasons. If you can easily go back, then get photos of the signs.  On GM and Parkopedia there are various comments about the signs being pants. Also go back to the school uniform shop and ask the manager there for contact details for the retail park (which I've Googled & Googled and got nowhere).  The school uniform shop will just be tenants of the retail park, they won't be able to do anything.  It will be the retail park that called EPC in, and we've seen loads of cases where the organ grinder has intervened and called off the monkey.  As for EPC, aye, ignore them until LoC stage.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes,

There are a few of us at CAG who have assisted with this programme - myself included. I just hope it goes a little further than some "others" have done, and finally puts a few chinks in BrightHouse's armour! (Although this film doesn't just single out BrightHouse, it takes a good old swipe at the entire sub-prime lending business.)

It's been hard keeping quiet about it, but seeing as the "embargo" has now been lifted (and the program is being aired tonight - and mentioned in today's the Sun) let the debate begin...

First impressions...

 

Nikki - you were brilliant! You came across as intelligent, genuine and very dignified. You should be very proud of yourself. Well done!

 

The fact that BrightHouse refused to participate (other than a few "standard" PR blurbs) means we caught them well and truly with their pants down! I would just LUUUUVE to be a fly on the wall at the director's meeting tomorrow morning!

 

It's a shame their debt collection "methods" weren't highlighted - but I can understand the reason for this. The piece focused on the high price of credit to the sub-prime, and its inclusion could have confused the intended message.

 

The producer, Steve Walsh, did a very good job of condensing a LOT of information into a 20 minute segment - and kept true to his word. So many thanks to him.

 

Thanks to all CAG members who may have helped with this film.

 

I am now off to buy a washing machine from Harrods. I understand they're quite a bit cheaper than buying one from BrightHouse.

Ex-Retail Manager who is happy to offer helpful advise in many consumer problems based on my retail experience. Any advise I do offer is my opinion and how I understand the law.

Well LEFTY the debate hasn't marerialized, which again hasn't surprised me This was a damp squib. Our customer base don'y on the whole watch c4 not when Corrie/Eastender/Corrie is on.WHICH BY THE WAY IS A GOOD JOB BECAUSE I JUST WATCHED A 20/30 SEGMENTOF FILM THAT WAS ADVERTISING PURE GOLD. I am talking about when NIKKI started telling everyone what she got out of BH. starting with her washing machine then onto her tumble dryer then moving on to her monitor and finally sitting on her suite telling everyone she got this for £5.00pm inc. osc/dlc. This was a better advert than the current one still running and costing many many thousands of pounds. All this with a big smile on her face 'as i said pure gold. NIKKI could have a new career in front of her she could become the SUSAN BOYLE of ADVERTISING.as for being a fly on the wall i am sure LEO MCKEE would be telling someone to phone the shop and cancel out NIKKI'S DEBT. padre.

Hi Padre. I'm Nikki (who featured in Dispatches) and i am not sure if you are taking the mick out of me or are being sincere.

 

I was told to give a description of my items including when i bought them, how much i was paying and when they would be payed off. I would like to clear a few things up though. The only 1 of my items that has OSC on is the washing machine (it constantly breaks down) as i removed the expensive OSC from all my other items. I personally would not recommend people buy items from Brighthouse unless it was essential.

 

The part where i explained the problems i had suffered with the washing machine was edited out and where i said that people should only buy essentials.

 

My Washing Machine is an essential item (my daughter and i are both Eczema sufferers), my dryer is used for large items (eg bedding) to be dried, the sofa i bought as a replacement for the old sofa and i intend to get many years use out of it and as for the monitor i bought it as a birthday present for my 30th last year.

 

Within the next year i will have paid Brighthouse off in full and i will never buy from them ever again.

Yep - BrightHouse REALLY like to dumb down their customers don't they? - well, actually they don't in public, but YOU do!!!

I think, although falling some way short, the piece did a good job of exposing some of the underhand tactics BrightHouse employ... Whizzing through contracts... admitting to loading OSC and DLC automatically... admitting OSC is where they make their money... not caring a kipper about the financial welfare of their customers (I don't CARE if she's skint)... and so on.

It was a piece designed to highlight the unfair playing field that exists for people unable to obtain mainstream credit, and on that count the film succeeded.

You should really take a leaf out of Buy As You View's book. They get many, many complaints on here (just like BrightHouse), but they do not encourage over-zealous employees to jump in and comment. No. The company has registered as a member here, and simply replies to each complaint with an aplogy and a link to their customer care line.

Although I am not in any way in support of BAYV, I really do think this approach is far more professional.
