Hi

My partner is disabled and has a badge. Today (Saturday) we parked on a side street that had a single yellow line with a sign that said 'no loading between 8am and 6pm Mon - Sat. There was a white boxed area that said loading so we avoided this section and parked just where it was the single yellow line, there was another car with a disabled badge parked behind us. We returned 35mins later to find we had a parking ticket. Can you tell us what we did wrong?

You parked on an active loading restriction. This is made crystal clear

in the information booklet that comes with your Blue Badge.

 

 

Conditions:

Badge holders may park on single or double

yellow lines for up to three hours in England

and Wales except where there is a ban on

loading or unloading

A nicely worded letter to the Council might see some discretion applied.

Thank you for that. We didn't know, we haven't got a blue badge booklet as my partner has had the badge for 9/10 years and it gets renewed every few years. We will send a polite letter in asking for an explanation like you have offered and see how we gget on. Will keep you updated.

Yep, I am afraid that is correct. However, there is always a possible problem with the sign or blip markings. There should be yellow stipes along the kerb at right angles to it. Were they present? Was the yellow line clear, unbroken and terminated correctly?

 

If all are correct, your only option is a very polite letter requesting compassion as you genuinely thought you were parking correctly and now you are aware you will ensure it doesn't happen again. You never know.....

Thanks again - there were yellow lines on the kerb. I will try the letter option but you can be sure I wont make the same mistake - neither will my partner :-) will let you know how I get on.

Ignorance is not an acceptable defence..

 

I'm assuming that U had an ORANGE badge....???

And that, that was changed to the Blue Badge

in the new Legislation..

 

If you didn't get the acceptable use booklet you need to ask for it,

or, as already posted, download and print it yourself from here....

I have a blue badge, but never had an orange badge myself, so you cannot assume that everyone else did either.

 

The blue badge booklet is suposed to be sent with every blue badge issued. I have had 3 badges now and each time I have been sent the book, but sometimes councils wiill forget. It is possible they didn't send you the booklet, but how wopuld you then now how and where to use the badge?

 

Be advised, if you are planning on going to central London at anytime, the blue badge cannot be used in large areas of it.

You can guarantee it - especially if the holder had had it for 9/10 years. The Blue badge only came along in April 2000.

 

However, in addition to parking regulations, there are a good many Off-Street car parks that now require BB holders to PAY. There may be a few token spaces marked for disabled use, but once these are taken, any other space is for ALL users, and a BB provides no benefit.

 

You really need to keep your wits about you.

Just to be clear, you're going to appeal it - so you need to give the explanation of what happened, and request they apply leniency to the case.

 

Sometimes people do exactly what you've said - write in and ask for an explanation. It gets treated as an appeal, and is inevitably rejected as it doesn't give a reason as to why the PCN should be cancelled!

I was trying to establish if the OP was an original ORANGE BADGE Holder..

The OP states has held the Badge for 9/10 years which falls into the remit

of the Orange /badge...

 

No need to jump down my throat!

 

If the OP was Orange, then Blue, but didn't get the information

to the new Legislation in the transition, I was trying to supply this

information...

 

Indeed, the BB Booklet is supposed to be sent with EVERY Blue Badge..

Maybe not, in this case...? Maybe a mistake was was made??

 

Seems that there's been a problem, YES..?

 

Is it any wonder that people are apprehensive about posting
